PURPOSE OF AMENDMENT - DECEMBER 2005

THE PURPOSE OF THIS AMENDMENT IS TO WITHDRAW THE PORTION(S) OF THE KAZN APPLICATION SPECIFYING NIGHTTIME FACILITIES FILED ON OCTOBER 20, 2005. A NEW NIGHTTIME TRANSMITTER SITE SEPARATE FROM THE DAY FACILITIES WAS PROPOSED. THE OCTOBER 2005 AMENDMENT WAS FILED IN CONNECTION WITH A REQUEST FOR SPECIAL TEMPORARY AUTHORITY ('STA') FOR NIGHTTIME OPERATION AT THE SAME SITE AS THE PROPOSED DAYTIME FACILITIES. THE COMMISSION'S AUDIO DIVISION STAFF HAS INFORMED THE APPLICANT THAT THE NIGHTTIME FACILITIES ARE NOT ACCEPTABLE FOR GRANT AT THIS TIME AND THAT IF THE NIGHTTIME AMENDMENT WERE TO BE WITHDRAWN, THEN THE STA COULD BE GRANTED. AS A RESULT, ALL OF QUESTION 5 - NIGHTTIME OPERATION IN SECTION III-A - AM ENGINEERING OF FCC FORM 301 HAS BEEN CHANGED. THE APPLICANT RECOGNIZES THAT IT WILL NEED TO FILE A NEW NIGHTTIME APPLICATION FOR PERMANENT FACILITIES IN THE FUTURE. THUS, GOOD CAUSE IS PROVIDED FOR THIS AMENDMENT.


GOOD CAUSE SHOWING - OCTOBER 2005

THIS AMENDMENT IS FILED IN RESPONSE TO THE COMMISSION'S LETTER OF APRIL 29, 2005, WHICH IDENTIFIED A CONFLICT WITH THREE PENDING APPLICATIONS FOR NEW AM STATIONS IN HAWAII. THE LETTER PROVIDES MULTICULTURAL WITH THE OPPORTUNITY TO AMEND AND RESOLVE THE CONFLICT OR BE PLACED ON HOLD PENDING THE RESOLUTION OF THOSE APPLICATIONS. THIS AMENDMENT RESOLVES THE CONFLICT WITH ALL THREE APPLICATIONS. THUS, MULTICULTURAL HAS PROVIDED GOOD CAUSE FOR FILING THIS AMENDMENT PURSUANT TO SECTION 73.3522(E).

MULTICULTURAL HAS BEEN DILIGENTLY SEARCHING FOR A NEW TRANSMITTER SITE TO SOLVE THIS NIGHTTIME CONFLICT. MULTICULTURAL HAS ENCOUNTERED A NUMBER OF OBSTACLES THAT HAVE MADE IT DIFFICULT TO LOCATE A NEW SITE IN A PROPERLY ZONED AREA WHICH PROVIDES THE REQUISITE SIGNAL OVER PASADENA AND PROTECTS THE THREE HAWAIIAN APPLICANTS (AS WELL AS ALL OTHER APPLICANTS IN THIS MUTUALLY EXCLUSIVE GROUP WHICH TOTALS 116 APPLICATIONS).

UNFORTUNATELY, MULTICULTURAL MUST VACATE ITS CURRENT TRANSMITTER SITE. LOCAL ZONING LAWS HAVE CHANGED AS A RESULT OF A CHANGE IN THE CHARACTER OF THE SURROUNDING AREA FROM COMMERCIAL/INDUSTRIAL TO RESIDENTIAL. THE RESIDENTS DO NOT WANT THE EXISTING TOWERS TO REMAIN. LOCAL ZONING LAWS PROHIBIT ANY REPAIRS TO THE TOWERS. MULTICULTURAL WILL HAVE NO RECOURSE IF THERE IS A NEED TO MAKE A REPAIR ANY TIME IN THE FUTURE. AFTER A CONSIDERABLE ENGINEERING EFFORT, MULTICULTURAL HAS DETERMINED THAT THERE IS NO APPARENT WAY TO BOTH SERVE ITS PRINCIPAL COMMUNITY AND PROTECT THE HAWAIIAN APPLICATIONS AT THE SPECIFIED SITE. THIS IS DUE TO THE RELATIVELY HIGH NIGHT INTERFERENCE-FREE LIMIT OF KAZN.

THIS DIFFICULT SITUATION IS EXACERBATED BY THE FACT THAT THE LAND ON WHICH THE TOWERS ARE LOCATED IS PLANNED FOR REDEVELOPMENT AND MULTICULTURAL HAS BEEN UNDER INCREASED PRESSURE TO TAKE THESE TOWERS DOWN AND VACATE THE PREMISES. THE QUICKEST SOLUTION IS FOR MULTICULTURAL TO RELOCATE THIS FACILITY TO ANOTHER TRANSMITTER SITE THAT IT OWNS. THAT IS THE PURPOSE OF THIS APPLICATION. HOWEVER, ONCE IT BECAME APPARENT THAT THE SITE SPECIFIED IN THIS APPLICATION COULD NOT BE GRANTED DUE TO THE NIGHTTIME PROBLEM, MULTICULTURAL SEARCHED FOR AND FINALLY FOUND ANOTHER NIGHTTIME SITE AND PREPARED THIS AMENDMENT. THIS NIGHTTIME SITE WILL REQUIRE FAA AND ZONING APPROVALS. THUS THE MOVE TO THIS LOCATION WILL NOT BE POSSIBLE IN TIME TO AVOID THE NEED TO VACATE THE CURRENT SITE. THEREFORE, MULTICULTURAL WILL BE FILING A REQUEST FOR SPECIAL TEMPORARY AUTHORITY TO OPERATE BOTH DAY AND NIGHT AT THE DAYTIME SITE UNTIL THE THREE PENDING HAWAIIAN AM APPLICATIONS ARE RESOLVED. MULTICULTURAL WAITED UNTIL NOW TO PRESENT THIS SOLUTION BECAUSE IT NEEDED TO DEMONSTRATE THAT IT HAS A PERMANENT SOLUTION TO THE NIGHTTIME CONFLICT.
