BASIS FOR STA REQUEST

WRCE(AM)'S TOWER COLLAPSED ON DECEMBER 14, 2009, TAKING THE STATION OFF THE AIR. WRCE(AM)'S LICENSEE, BACKYARD BROADCASTING ELMIRA LICENSEE, LLC ('BACKYARD') NOTIFIED THE COMMISSION OF THE STATION'S SUSPENSION OF OPERATIONS AND REQUESTED CONTINUED SILENT AUTHORITY ON DECEMBER 15, 2009. THE COMMISSION GRANTED SILENT AUTHORITY ON JANUARY 8, 2010. SEE FCC FILE NO. BLSTA-20091215ABV.

ON JANUARY 29, 2010, BACKYARD NOTIFIED THE COMMISSION, PURSUANT TO SECTION 73.1680(B) OF THE COMMISSION'S RULES, THAT WRCE(AM) HAD RESUMED LOW POWER OPERATIONS WITH AN EMERGENCY ANTENNA. BACKYARD NOW RESPECTFULLY REQUESTS THAT THE COMMISSION GRANT WRCE(AM) SPECIAL TEMPORARY AUTHORITY TO CONTINUE LOW POWER OPERATIONS WITH A TEMPORARY EMERGENCY ANTENNA WHILE IT REBUILDS ITS TOWER.

BECAUSE OF SPACE LIMITATIONS AT WRCE(AM)'S TRANSMITTER SITE, ERECTING AN EMERGENCY WIRE ANTENNA IS NOT PRACTICAL. INSTEAD, WRCE(AM) HAS PURCHASED A MORAD ELECTRONICS CORP. ANTENNA, MODEL 9183, STYLE SF-1610, TO SERVE AS ITS EMERGENCY ANTENNA. THIS PARTICULAR ANTENNA IS PRIMARILY USED FOR TRAVELERS INFORMATION STATIONS (TIS) IN THE AM BROADCAST BAND. THE ANTENNA IS MOUNTED AT APPROXIMATELY 30 FEET ABOVE GROUND ON A TELESCOPIC MAST AT WRCE(AM)'S AUTHORIZED TRANSMITTER LOCATION. BECAUSE OF THE POWER LIMITATION OF THE EMERGENCY ANTENNA, WRCE(AM) WILL MAINTAIN A TPO OF 100 WATTS. FURTHERMORE, THIS PARTICULAR ARRANGEMENT ACHIEVES 32 MV/M AT 1 KM.

BACKYARD EXPECTS THAT OPERATING WITH THE PROPOSED FACILITY WILL ENABLE WRCE(AM) TO RESTORE SERVICE TO ITS COMMUNITY OF LICENSE, WATKINS GLEN, NY. BACKYARD ALSO CERTIFIES THAT, GIVEN THE REDUCED OPERATING POWER, THE PROPOSED FACILITY WILL NOT HAVE A SIGNIFICANT ENVIRONMENTAL IMPACT AND THEREFORE COMPLIES WITH THE MAXIMUM PERMISSIBLE RADIOFREQUENCY ELECTROMAGNETIC EXPOSURE LIMITS FOR CONTROLLED AND UNCONTROLLED ENVIRONMENTS.

WRCE(AM) IS WORKING ON ERECTING A REPLACEMENT TOWER. BECAUSE THE AREA'S WEATHER IS NOT CONDUCIVE TO TOWER CONSTRUCTION AT THIS TIME, WRCE(AM) EXPECTS TO HAVE THE AM BROADCAST FACILITY RESTORED TO FULLY LICENSED POWER WITHIN 180 DAYS.

ACCORDINGLY, BACKYARD RESPECTFULLY REQUESTS SPECIAL TEMPORARY AUTHORITY TO OPERATE AT VARIANCE FROM ITS AUTHORIZATION FOR 180 DAYS WHILE BACKYARD COMPLETES CONSTRUCTION OF WRCE(AM)'S REPLACEMENT TOWER.
