STA CIRCUMSTANCES

KXFD (FORMERLY KCMD), HAS BEEN OPERATING WITH PARAMETERS AT VARIANCE WHILE MAINTAINING MONITOR POINTS WITHIN LICENSED VALUES, PURSUANT TO SPECIAL TEMPORARY AUTHORITY (STA) GRANTED JANUARY 23, 2009, AND SUBSEQUENTLY EXTENDED. THE CURRENT EXTENSION WILL EXPIRE ON FEBRUARY 24, 2011. A FURTHER EXTENSION IS RESPECTFULLY REQUESTED.

IN JANUARY 2009, ONE OF THE GUYS ON A NEARBY DE-TUNED TALL FM/TV TOWER BROKE DURING AN ICE STORM. THE GUY WAS REPLACED WITH A TEMPORARY GUY THAT DID NOT HAVE INSULATORS, WHICH ADVERSELY AFFECTED THE KXFD ANTENNA PATTERN. KXFD REDUCED POWER UNTIL THE MONITOR POINT WAS WITHIN LIMITS. THE STATION CONTINUES TO OPERATE AT THAT REDUCED POWER.

ALPHA LICENSEE, LLC ACQUIRED STATION KXFD IN NOVEMBER 2009. AS PREVIOUSLY REPORTED, ALPHA HAS ENCOUNTERED SEVERAL ISSUES RELATING TO THE TRANSMISSION SYSTEM INCLUDING FLUCTUATIONS IN PARAMETERS DURING PERIODS OF HIGH WINDS AND A TRANSMITTER UNDER-DRIVE CONDITION. WHILE ALPHA WORKED TO ASSESS AND ADDRESS THOSE ISSUES, A DECISION WAS MADE BY SYLVAN TOWER CO. LLC, OWNER OF THE ADJACENT TALL TOWER, TO DECONSTRUCT THE TOWER. IT IS UNDERSTOOD THAT REMOVAL OF THE TOWER WILL REQUIRE LOCAL PERMITS WHICH HAVE OR WILL SOON BE REQUESTED. A FURTHER EXTENSION OF THE KXFD STA IS REQUESTED PENDING THE REMOVAL OF THE TOWER.
