REASONS FOR EXTENSION

WTIX, INC., THE LICENSEE OF STATION WIST (AM), NEW ORLEANS, LA, HEREIN REQUESTS EXTENSION OF BSTA-20050922AFY, AS MOST RECENTLY EXTENDED BY BESTA-20110207ADH (WITH AN EXPIRATION DATE OF OCTOBER 13, 2011).

AS DETAILED IN PREVIOUS STA EXTENSION REQUESTS, THE STATION'S LICENSED FOUR-TOWER FACILITY WAS SEVERELY DAMAGED IN HURRICANE KATRINA. FULL RECONSTRUCTION OF THAT FACILITY IS FINANCIALLY PROHIBITIVE.

ON SEPTEMBER 29, 2010, THE COMMISSION GRANTED THE WIST LICENSEE'S SEPARATE MODIFICATION APPLICATION FOR ITS DAYTIME FACILITIES (BP-20100609AGJ). THE CONSTRUCTION PERMIT SPECIFIES NONDIRECTIONAL OPERATION WITH 9.1 KW FROM A SHORTER TOWER TO BE CONSTRUCTED AT THE SAME LOCATION AS ONE OF THE TOWERS USED IN THE STATION'S PRE-KATRINA FOUR-TOWER ARRAY.

THE WIST LICENSEE ALSO HAS PENDING AN APPLICATION FOR WIST'S NIGHTTIME FACILITIES. THAT APPLICATION, BP-20070925AGL, SPECIFIES OPERATION WITH 2.1 KW USING A TWO TOWERS, ONE OF WHICH IS THE TOWER SPECIFIED IN BP-20100609ACJ. PROCESSING OF THIS APPLICATION HAS BEEN DELAYED PENDING RESOLUTION OF CERTAIN ENVIRONMENTAL ISSUES.

THE LICENSEE RETAINED CIVIL ENGINEERING AND ENVIRONMENTAL CONSULTANTS TO PREPARE AN ENVIRONMENTAL ASSESSMENT, WHICH IS NEARLY COMPLETE. A JOINT PERMIT APPLICATION SEEKING APPROVAL OF THE TOWER CONSTRUCTION PROJECT BY THE LOUISIANA DEPARTMENT OF NATURAL RESOURCES AND THE U.S. ARMY CORPS OF ENGINEERS IS BEING FILED THIS WEEK. ONCE THAT JOINT PERMIT IS GRANTED, THE ENVIRONMENTAL ASSESSMENT WILL BE FINALIZED AND FILED WITH THE FCC.

PENDING COMMISSION ACTION OF THE LICENSEE'S PENDING MODIFICATION APPLICATION AND THE SUBSEQUENT CONSTRUCTION OF THE STATION'S NEW TOWERS, THE LICENSEE RESPECTFULLY REQUESTS AUTHORITY TO CONTINUE ITS OPERATION OF WIST WITH AN EMERGENCY NONDIRECTIONAL ANTENNA AND REDUCED POWER NOT TO EXCEED 2.5 KILOWATTS DAYTIME AND 1.25 KILOWATTS NIGHTTIME.
