7.7. Environmental Protection Act.     The proposed facility is excluded from environmental processing under 47. C.F.R. Section 1.1306 (i.e., The facility will not have a significant environmental impact and complies with the maximum permissible radiofrequency electromagnetic exposure limits for controlled and uncontrolled environments). Unless the applicant can determine compliance through the use of the RF worksheets in Appendix A, an Exhibit is required.

IT IS BELIEVED THAT THE PROPOSED STA OPERATION WOULD BE EXCLUDED FROM ENVIRONMENTAL PROCESSING UNDER 47. C.F.R. SECTION 1.1306 SINCE NO PHYSICAL CHANGES WILL BE MADE AT THE SITE - ONLY REPAIRS TO EXISTING SYSTEMS WILL BE INVOLVED, THEREFORE THE STA FACILITY WILL NOT CREATE A SIGNIFICANT ENVIRONMENTAL IMPACT OR ANY CHANGE TO THE PREVIOUSLY AUTHORIZED OPERATION.

FURTHER, THE STA FACILITY WILL EITHER OPERATE WITH AUTHORIZED POWER LEVELS AND MODES, OR WITH REDUCED POWER LEVELS AND MODES. SINCE THE LICENSED FACILITY WAS PREVIOUSLY DETERMINED BY OTHERS TO COMPLY WITH THE MAXIMUM PERMISSIBLE RADIOFREQUENCY ELECTROMAGNETIC EXPOSURE LIMITS FOR CONTROLLED AND UNCONTROLLED ENVIRONMENTS, OPERATION WITH THE EQUIVALENT OR REDUCED POWER FACILITIES WOULD ENSURE CONTINUED COMPLIANCE.

THE WNVR SITE IS A SINGLE USER SITE, COORDINATION WITH OTHER USERS OF THE SITE (SITE WORKERS) AS NECESSARY. POWER WILL EITHER BE REDUCED OR OPERATION WILL CEASE IN ORDER TO PROTECT PERSONS HAVING ACCESS TO THE SITE, TOWER OR ANTENNA FROM RADIOFREQUENCY ELECTROMAGNETIC EXPOSURE IN EXCESS OF FCC GUIDELINES. NO ONE WILL BE PERMITTED TO TOUCH, STAND NEAR, OR CLIMB AN ENERGIZED TOWER. EXHIBIT 16 - STA REQUEST DETAILS

WNVR HAS RECENTLY EXPERIENCED NUMEROUS RF SYSTEM COMPONENT FAILURES, EXPECTED TO BE DUE, IN PART, TO THE SERIES OF STORMS THAT HAVE PASSED THROUGH THE AREA. IT IS PRESENTLY NOT POSSIBLE TO OPERATE THE STATION RELIABLY AT FULL POWER OR WITHIN THE LICENSED ANTENNA MONITOR PARAMETERS. THE SPECIFIC RULES AND/OR POLICIES FROM WHICH THE APPLICANT SEEKS TEMPORARY RELIEF INCLUDE SECTIONS 73.62(A), 73.62(C)(3), AND 73.1560(A).

THE PUBLIC INTEREST WILL BE FURTHERED BY A GRANT OF THE ENGINEERING STA REQUEST IN THAT CONTINUED SERVICE WILL BE PROVIDED TO THE COMMUNITY OF LICENSE.

THE EXPECTED DURATION OF THE STA IS NOT PRESENTLY KNOWS SINCE THE DIAGNOSTIC EFFORT IS STILL UNDERWAY. AN STA FOR AT LEAST 90 DAYS, AND PREFERABLY 120 DAYS, IS HEREIN RESPECTFULLY REQUESTED.

THE LICENSEE'S PLAN FOR RESTORATION OF LICENSED OPERATION INVOLVES THE CONTINUATION OF COMPONENT INSPECTION AND TESTING UNTIL ALL DEFECTIVE ITEMS HAVE BEEN REPLACED (OUTSIDE ENGINEERS HAVE BEEN TASKED WITH THE EVALUATION AND IF NECESSARY, THE RETUNING PROCESS) AND THE CONTINUED ENGAGEMENT OF TOWER WORKERS TO INSPECT TOWER SYSTEMS TO ENSURE ALL WELDS ARE STILL CORRECT AND ALL INSULATING ITEMS HAVE NOT BEEN CARBON TRACKED. ONCE THE ANTENNA MONITOR PARAMETERS ARE RETURNED TO NORMAL, THE MONITOR POINTS WILL BE CHECKED. IT WILL THEN BE DETERMINED IF A PARTIAL PROOF OF PERFORMANCE WILL BE NECESSARY OR IF A FCC FORM 302 FILING WILL BE NEEDED TO REQUEST REVISED PARAMETERS.

IT IS REQUESTED TO OPERATE AT VARIANCE WITH ANTENNA MONITOR PARAMETERS (OR OPERATING POWER) ONLY. NO OTHER FACILITY CHANGES (SUCH AS TOWER CHANGES) ARE BEING PROPOSED. THE AUTHORIZED TECHNICAL FACILITIES (TOWERS, TOWER LAYOUT, MEANS OF EXCITATION) WILL REMAIN AS LICENSED.
