EXTRAORDINARY CIRCUMSTANCES

AS SHOWN IN THE INITIAL REQUEST FOR STA (FILE NO. BESTA-20090129ABH), THE FORMER LICENSEE OF WSRQ DETERMINED THAT DUE TO ZONING PROBLEMS, IT NEEDED TO MODIFY THE CONSTRUCTION PERMIT OF THE STATION TO PROPOSE SINGLE TOWER OPERATION.

FLORIDA TALK RADIO, LLC (FTR) BECAME THE LICENSEE OF WSRQ ON SEPTEMBER 20, 2011 (FCC FILE NO. BAL-2011110824CA). ON DECEMBER 14, 2011, FTR FILED AN APPLICATION TO MOVE THE TOWER SITE AND CHANGE THE DIRECTIONAL ARRAY OF THE STATION (FCC FILE NO. BP-20111214AEF, GRANTED BY THE FCC ON JANUARY 18, 2012). HOWEVER, SUBSEQUENT TO THE GRANT OF THE AFOREMENTIONED CONSTRUCTION PERMIT, FTR WAS ADVISED FOR THE FIRST TIME OF ZONING PROBLEMS BY THE OWNER OF THE TOWER SITE.

FTR LOCATED A SUITABLE TOWER SITE AND FILED AN APPLICATION FOR MODIFICATION OF CONSTRUCTION PERMIT WHICH SPECIFIES THE NEW SITE. ON MAY 6, 2014, THE MEDIA BUREAU GRANTED THE APPLICATION. SEE (FILE NO. BMP20131021AGL). FTR HAS BEEN OPERATING FROM THIS STA SITE AND DESIRES TO CONTINUE TO SERVE THE PUBLIC INTEREST FROM THIS SITE UNTIL THE NEW CP FACILITY IS BUILT.

CONSTRUCTION AT THE NEW SITE HAS BEEN DELAYED DUE TO CIRCUMSTANCES BEYOND THE CONTROL OF FTR. WHEN FTR FILED AN APPLICATION TO MOVE THE NEW SITE, THE OWNER OF THE TOWER WAS SUNSHINE STATE BROADCASTING CO., INC. IN OCTOBER OF LAST YEAR, THE TOWER WAS SOLD TO CELL SITE CAPITAL, LLC. BEGINNING IN NOVEMBER, FTR HAS BEEN NEGOTIATING THE TERMS OF A NEW LEASE WITH CHRIS BRAND OF CELL SITE CAPITAL, LLC. A NEW LEASE HAS NOT BEEN SIGNED BECAUSE CELL SITE IS PROPOSING TO A 100% INCREASE IN THE MONTHLY LEASE PAYMENT. THE CONSTRUCTION AT THE CP SITE HAS DEFERRED UNTIL A NEW LEASE HAS BEEN SIGNED. IN THE MEANTIME, FTR HAS EXPANDED FUNDS TO HAVE THE CP SITE SURVEYED AND TO COMPLETE THE PRELIMINARY DESIGN OF THE ANTENNA SYSTEM EQUIPMENT THAT WILL BE NEEDED AT THE SITE. BECAUSE OF THE POSSIBILITY THAT CELL SITE CAPITAL AND FTR MAY NOT AGREE ON THE TERMS OF NEW LEASE, FTR HAS ALSO BEEN ACTIVELY SEARCHING FOR AN ALTERNATE SITE.

TO KEEP THE STATION ON THE AIR, A FURTHER EXTENSION OF TIME IS REQUESTED TO OPERATE WSRQ WITH TEMPORARY FACILITIES AT THE STA SITE. THIS REQUEST IS CONSISTENT WITH THE FCCS POLICIES THAT INVOLVE A CHANGE IN TRANSMITTER SITE, NAMELY, (1) LOSS OF THE SITE IS BEYOND THE LICENSEES CONTROL; (2) THE STA FACILITIES WILL CONTINUE TO PROVIDE SERVICE TO SARASOTA, FLORIDA, WSRQS LICENSED COMMUNITY; (3) THE STA FACILITIES WILL MAINTAIN, AS CLOSELY AS PRACTICABLE, THE LICENSED SERVICE AREA WITHOUT EXTENDING IT; AND (4) THE STA FACILITIES DO NOT INVOLVE THE CONSTRUCTION OF TOWERS INTENDED FOR PERMANENT USE BY FTR.
