Section 1.1306 (i.e., The facility will not have a significant environmental impact and complies with the maximum permissible radiofrequency electromagnetic exposure limits for controlled and uncontrolled environments). JUSTIFICATION

KDBS HAS LOST ITS TRANSMITTING TOWER DUE TO AN AUTOMOBILE ACCIDENT WHICH BROKE A GUY WIRE. TO RESTORE SERVICE ASAP, CENLA INTENDS TO BROADCAST FROM A TEMPORARY FACILITY LOCATED ON A TOWER AT THEIR STUDIOS AT 1115 TEXAS AVE IN ALEXANDRIA, LA (31 17 30 N. 092 28 24 W). THIS SITE IS LESS THAN 5 KM FROM ITS LICENSED SITE. KDBS PROPOSES TO OPERATE AT 250 WATTS DAYTIME (1/4TH CURRENTLY LICENSED POWER) AND 30 WATTS NIGHTIME (SAME AS CURRENTLY LICENSED POWER).

ACCORDING TO 47 CFR 74.1201(G), THIS SHOULD NOT AFFECT THE OPERATIONS OF ASSOCIATED TRANSLATOR K234CY. HERE IS THE RELEVANT WORDING FROM THAT REGULATION:

(G)...THE COVERAGE CONTOUR OF AN FM TRANSLATOR REBROADCASTING AN AM RADIO BROADCAST STATION AS ITS PRIMARY STATION MUST BE CONTAINED WITHIN THE GREATER OF EITHER THE 2 MV/M DAYTIME CONTOUR OF THE AM STATION OR A 25-MILE (40 KM) RADIUS CENTERED AT THE AM TRANSMITTER SITE. THE PROTECTED CONTOUR FOR AN FM TRANSLATOR STATION IS ITS PREDICTED 1 MV/M CONTOUR.

IT CAN CLEARLY BE SEEN FROM THE ATTACHED MAP THAT THE 1 MV/M CONTOUR OF K234CY IS WELL WITHIN THE 25 MILE RADIUS OF THE TEMPORARY SITE.

THIS STA IS IN THE PUBLIC INTEREST AS IT WILL RESTORE AN AURAL SERVICE TO THE PUBLIC. KDBS REQUESTS AUTHORIZATION FOR 180 DAYS WHILE IT EVALUATES ITS OPTIONS FOR A NEW PERMANENT TRANSMITTER SITE.
