PUBLIC BROADCASTING OF COLORADO, INC. ('PBC') RECENTLY EXCHANGED ITS CONSTRUCTION PERMIT FOR A NEW STATION ON 88.1 MHZ AT GLENWOOD SPRINGS, CO. WITH CARBONDALE COMMUNITY ACCESS RADIO, INC.'S LICENSE FOR 90.5 MHZ, CARBONDALE, CO. THE EXCHANGE WAS CONSUMMATED OCTOBER 29, 2004, PURSUANT TO COMMISSION APPROVAL IN FILE NOS. BALED-20040819ACD AND BAPED-20040820AAB.

AS SUCH, PUBLIC BROADCASTING OF COLORADO, INC. BELIEVED THAT KVOV WOULD NOT BE SUBJECT TO THIS RENEWAL CYCLE. IT WAS ONLY RECENTLY, UPON CONDUCTING A 'STATION' SEARCH IN CDBS, THAT THE LICENSE EXPIRATION DATE OF OF 4/1/05 WAS DISCOVERED. AT THAT POINT PBC MOVED QUICKLY TO FILE THIS APPLICATION. (IN THIS REGARD, IT SHOULD BE NOTED THAT PBC TIMELY FILED NUMEROUS OTHER RENEWAL APPLICATIONS BY THE APPOINTED DATE (DECEMBER 1).

ACQUIRED THE STATION IN QUESTION OPERATING ON 90.5 MHZ JUST A FEW WEEKS AGO, AND DISCOVERED ONLY VERY RECENTLY THAT IT WAS OBLIGATED TO FILE A RENEWAL APPLICATION FOR THE FACILITY. AN EEO REPORT WAS FILED YESTERDAY. CONSEQUENTLY, THE AFFIRMATIVE ANSWER TO THIS QUESTION IS QUALIFIED BY THE INFORMATION SET FORTH IN THIS EXHIBIT RELATIVE TO THE LATE FILING.
