EXTRAORDINARY CIRCUMSTANCES WHICH WARRANT TEMPORARY OPERATIONS

THE APPLICANT RESPECTFULLY REQUESTS SPECIAL TEMPORARY AUTHORITY, PURSUANT TO SECTIONS 73.1635 AND 73.1680 OF THE RULES, TO RETURN STATION KOAY(FM) TO THE AIR USING AN EMERGENCY ANTENNA. THE TECHNICAL SPECIFICATIONS OF THIS TEMPORARY OPERATION ARE PROVIDED IN ATTACHMENT 4.   

AS REPORTED ON FEBRUARY 29, 2008, THE LICENSEE OF THIS STATION IS IN BANKRUPTCY AND THE LANDLORD OF ITS LICENSED TRANSMITTER SITE HAS NOT AND WILL NOT ALLOW 3 POINT MEDIA - FRANKLIN, LLC, ACCESS TO THE SITE FOR FINANCIAL REASONS. RECENT POSITIVE DEVELOPMENTS GIVE THE APPLICANT HOPE THAT A SETTLEMENT WITH THE LANDLORD OF THE KOAY LICENSED TOWER SITE WILL BE REACHED IN THE COMING WEEKS SO THAT LICENSED OPERATIONS CAN RE-COMMENCE. IN THE MEANTIME, THE APPLICANT REQUESTS AUTHORITY TO INSTALL AN EMERGENCY ANTENNA ON AN OLD, EXISTING TOWER (FOR WHICH THE FAA HAS BEEN NOTIFIED) AND OPERATE WITH THE TECHNICAL SPECIFICATIONS PROVIDED IN THE ATTACHED TECHNICAL SHOWING.
