ENVIRONMENTAL STATEMENT

THE PROPOSED FM FACILITY HAS BEEN EVALUATED IN TERMS OF POTENTIAL RADIOFREQUENCY ELECTROMAGNETIC FIELD EXPOSURE AT GROUND LEVEL IN ACCORDANCE WITH OET BULLETIN NO. 65, EVALUATING COMPLIANCE WITH FCC SPECIFIED GUIDELINES FOR HUMAN EXPOSURE TO RADIOFREQUENCY ELECTROMAGNETIC FIELDS (OET BULLETIN 65, SECOND EDITION 97-01, AUGUST, 1997). THE COMMISSION'S FM MODEL POWER DENSITY PREDICTION PROGRAM WAS EMPLOYED TO DETERMINE THE FIELD. USING THE JAMPRO 'DOUBLE V' ANTENNA WITH 1 SECTION AND THE AGL HEIGHT AND ERP PROPOSED IN THIS APPLICATION, THE HIGHEST PREDICTED POWER DENSITY 2 METERS ABOVE GROUND IS LESS THAN 57.5% OF THE UNCONTROLLED STANDARD WITH A POWER DENSITY OF 114.85 MICROWATTS PER SQUARE CENTIMETER 4 METERS FROM THE BASE OF THE TOWER.

EVEN THOUGH THE SITE WILL FULLY COMPLY WITH THE UNCONTROLLED SITE STANDARDS, ACCESS TO THE TRANSMITTING SITE WILL BE RESTRICTED AND APPROPRIATELY MARKED WITH WARNING SIGNS. WHEN IT BECOMES NECESSARY FOR WORKERS TO ASCEND THE TOWER, APPROPRIATE MEASURES, SUCH AS REDUCTION OR SHUT DOWN OF POWER IF NECESSARY, SHALL BE TAKEN TO ENSURE THAT THE HUMAN EXPOSURE TO RADIOFREQUENCY RADIATION WILL NOT EXCEED THE FCC GUIDELINES.

THE PROPOSED FACILITY IS EXEMPT FROM ENVIRONMENTAL PROCESSING BECAUSE THE FACILITY IS NOT LOCATED AT A LOCATION SPECIFIED IN SECTION 1.1307(A)(1)-(8) OF THE COMMISSION'S RULES AND SINCE THE TOWER IN QUESTION ALREADY EXISTS.

JUSTIFICATION

STATION KESY LOST ACCESS TO ITS LICENSED TOWER AND IS CURRENTLY SILENT. THE STATION HAS BEEN GRANTED APPROVAL TO RELOCATE FROM CUBA, MISSOURI, ITS CURRENT COMMUNITY OF LICENSE, TO STEELVILLE, MISSOURI. THE STATION IS IN THE PROCESS OF SEEKING A NEW SITE SO THAT IT CAN SERVE ITS NEW COMMUNITY OF LICENSE. HOWEVER, THE STATION NEEDS TO RETURN TO THE AIR BY SEPTEMBER 5, 2009. ACCORDINGLY, KESY HEREIN REQUESTS FCC CONSENT TO BROADCAST WITH TEMPORARY FACILITIES TO SERVE CUBA, MISSOURI UNTIL SUCH TIME AS IT LOCATES A NEW SITE TO SERVE ITS NEW COMMUNITY OF LICENSE. THE STATION WILL OPERATE WITH A STUDIO LOCATED AT 615 N. MAIN STREET, CUBA, MISSOURI 65453.

ATTACHED ARE TWO MAPS OF THE PROPOSED TEMPORARY FACILITY DEMONSTRATING THAT THE TEMPORARY FACILITY WILL ENCOMPASS ALL OF CUBA, MO, WITH AN F(50,50) 70 DBU CITY-GRADE CONTOUR AND ANOTHER MAP DEMONSTRATING THAT THE PROPOSED TEMPORARY FACILITY'S F(50,50) 60 DBU CONTOUR DOES NOT EXCEED THE F(50,50) 60 DBU CONTOUR OF THE LICENSED KESY(FM) FACILITY.
