Section 1.1306 (i.e., The facility will not have a significant environmental impact and complies with the maximum permissible radiofrequency electromagnetic exposure limits for controlled and uncontrolled environments). STA CIRCUMSTANCES

ALPHA LICENSE, LLC ACQUIRED STATION KINK ON 11/6/2009. ALPHA HEREBY RESPECTFULLY REQUESTS SPECIAL TEMPORARY AUTHORITY TO OPERATE KINK AT 78% OF LICENSED POWER.

DURING A RECENT MOVE TO A NEW TRANSMITTER SITE, A SECTION OF FLEXIBLE TRANSMISSION LINE WAS SUBSTITUTED FOR HARD LINE AND WAS SUBSEQUENTLY FOUND TO HAVE A HIGHER LINE LOSS, RESULTING IN THE REDUCED POWER OPERATION. IN ORDER TO INCREASE TPO TO ACHIEVE LICENSED POWER, THE INPUT PORTS OF THE DIPLEXER MUST BE REPLACED.

THE MOVE OF TRANSMITTER SITE AND TRANSMISSION LINE INSTALLATION WAS COMPLETED BY THE PRIOR LICENSEE, CBS RADIO STATIONS, INC. CBS ALSO DISCOVERED THE LINE LOSS PROBLEM AND APPROPRIATELY REQUESTED SPECIAL TEMPORARY AUTHORITY TO OPERATE AT THE REDUCED POWER (BSTA-20090805AAR). THE STA WAS GRANTED FOR A PERIOD OF 90 DAYS THOUGH 11/6/2009 -- THE SAME DAY THAT CBS AND ALPHA CONSUMMATED THEIR TRANSACTION. INADVERTENTLY, DURING TO THE TRANSFER OF OWNERSHIP, NEITHER BUYER NOR SELLER REQUESTED EXTENSION OF THE STA AND THE STA EXPIRED ON 11/6/2009.

ALPHA HAS JUST DISCOVERED THE OVERSIGHT AND IS REQUESTING A NEW STA TO OPERATE AT 78% OF LICENSED POWER UNTIL IT CAN FINISH INSTALLING THE NEW INPUT PORTS. THE EQUIPMENT WAS ORDERED BY CBS AND HAS BEEN DELIVERED AND IS NOW ON SITE READY TO BE INSTALLED. THAT IS EXPECTED TO HAPPEN, FOLLOWED BY A SWEEP OF THE ANTENNA, WITHIN THE NEXT 30 DAYS. A NEW LICENSE APPLICATION WILL BE FILED TO REFLECT THE INCREASED TPO.
