THE STATION THAT IS THE SUBJECT OF THE INSTANT APPLICATION WAS PART OF MX GROUP 9806PP AND WAS AWARDED TO HOUSTON CHRISTIAN BROADCASTERS, INC., IN THE MARCH 27, 2007, MEMORANDUM OPINION AND ORDER IN COMPARATIVE CONSIDERATION OF 76 GROUPS OF MUTUALLY EXCLUSIVE APPLICATIONS FOR PERMITS TO CONSTRUCT NEW OR MODIFIED NONCOMMERCIAL EDUCATIONAL FM STATIONS, 22 FCC RCD 6101, 6150 & 6176 (2007). THE STATION LICENSE INCLUDES A CONDITION THAT SPECIFIES THAT IT IS SUBJECT TO A HOLDING PERIOD OF FOUR YEARS DURING WHICH HOUSTON CHRISTIAN BROADCASTERS, INC., CANNOT ASSIGN THE STATION LICENSE UNLESS IT CAN BE DEMONSTRATED THAT THE PROPOSED ASSIGNEE WOULD QUALIFY FOR AT LEAST THE SAME NUMBER OF POINTS THAT HOUSTON CHRISTIAN BROADCASTERS, INC., ORIGINALLY RECEIVED; AND THAT THE CONSIDERATION RECEIVED BY, AND/OR PROMISED TO, HOUSTON CHRISTIAN BROADCASTERS, INC. THE COMMISSION CHOSE HOUSTON CHRISTIAN BROADCASTERS, INC., AS THE PREVAILING APPLICANT IN THE MARCH 27, 2007 MO&O BECAUSE HOUSTON CHRISTIAN BROADCASTERS, INC., PROPOSED TO SERVE AT LEAST 25% MORE AREA AND POPULATION THAN THE ONLY OTHER APPLICANT IN THE MX GROUP, THUS ENTITLING HOUSTON CHRISTIAN BROADCASTERS, INC., TO TWO POINTS, WHEREAS THE OTHER APPLICANT IN THE MX GROUP WAS ENTITLED TO NO POINTS. AS WAS CERTIFIED BY HOUSTON CHRISTIAN BROADCASTERS, INC., IN THE COVERING LICENSE APPLICATION FILED BY IT UPON COMPLETION OF CONSTRUCTION OF THE STATION (BLED- 20100528ABP), THE STATION WAS CONSTRUCTED AS AUTHORIZED IN THE UNDERLYING CONSTRUCTION PERMIT. THE FACILITIES HAVE NOT BEEN MODIFIED SINCE THE GRANT OF THE LICENSE AND THE PROPOSED ASSIGNEE THUS WOULD BE ENTITLED TO THE TWO POINTS FOR THE SUPERIOR TECHNICAL FACILITIES PROPOSED BY HOUSTON CHRISTIAN BROADCASTERS, INC. CONSEQUENTLY, THE PROPOSED ASSIGNEE IS ENTITLED TO AT LEAST THE SAME NUMBER OF POINTS AS HOUSTON CHRISTIAN BROADCASTERS, INC., AND THUS THE FIRST HALF OF THE CONDITION, I.E., THAT THE PROPOSED ASSIGNEE BE ENTITLED TO AT LEAST THE SAME NUMBER OF POINTS AS HOUSTON CHRISTIAN BROADCASTERS, INC., HAS BEEN FULFILLED.
