MODIFIED MAIN STUDIO RULE WAIVER REQUEST

THE ASSIGNEE RESPECTFULLY REQUESTS TO MODIFY THE EXISTING WAIVER OF SECTION 73.1125 SO THAT IT CONFORMS WITH THE EXISTING WAIVERS IN PLACE FOR OUR OTHER FACILITIES. THE WORDING BELOW IS IDENTICAL TO THE WAIVERS WE HAVE OBTAINED FOR OUR OTHER FACILITIES, INCLUDING NEW-FM, RISING SUN, MD (FACILITY ID NO. 173256).

THE ASSIGNEE RESPECTFULLY REQUESTS A WAIVER OF SECTION 73.1125 OF THE COMMISSION'S RULES TO PERMIT THE LOCATION OF THE MAIN STUDIO OF THIS STATION AT THE MAIN STUDIO OF APPLICANT'S CO-OWNED STATION WVBV, MEDFORD LAKES, NJ (FACILITY ID NO. 122809) AND OPERATION OF THE STATION AS A SATELLITE OF WVBV. THE PROPOSED MAIN STUDIO WOULD BE LOCATED AT 55 EAST MAIN STREET, MARLTON, NEW JERSEY 08053.

BARNEGAT LIGHT HAD A 2000 POPULATION OF 764, TOO FEW PERSONS TO SUPPORT AN INDEPENDENTLY-OPERATED NCE STATION THROUGH CONTRIBUTIONS; AND GOVERNMENT FUNDING IS NOT AVAILABLE TO NCE STATIONS OPERATED BY FAITH-BASED ORGANIZATIONS SUCH AS THE ASSIGNEE.

BARNEGAT LIGHT IS APPROXIMATELY 44 MILES FROM THE WVBV STUDIOS. THE PROPOSED SATELLITE OPERATION WILL ENABLE THE ASSIGNEE TO REALIZE COST SAVINGS THAT WILL FACILITATE THE CONTINUED PROVISION OF HIGH-QUALITY, NON-COMMERCIAL PROGRAMMING TO THE PUBLIC. AS AN ENTITY WHICH DERIVES FINANCIAL SUPPORT FROM VOLUNTARY CONTRIBUTIONS, THE ASSIGNEE HAS LIMITED RESOURCES AND MUST ALLOCATE THEM IN THE MOST EFFICIENT MANNER TO STAY ON THE AIR. THE OBLIGATION TO MAINTAIN SEPARATE STAFFING AND STUDIO FACILITIES AT BOTH BARNEGAT LIGHT AND MARLTON WOULD PLACE A SERIOUS FINANCIAL BURDEN UPON THE ASSIGNEE AND NEEDLESSLY DIVERT PRECIOUS RESOURCES FROM PROGRAMMING EFFORTS.

THE ASSIGNEE WILL COMPLY WITH ALL TECHNICAL RULES AND REGULATIONS, INCLUDING EAS REQUIREMENTS. TO ASSURE THAT THE PROPOSED STATION FULFILLS ITS LOCAL SERVICE OBLIGATIONS TO THE RESIDENTS OF BARNEGAT LIGHT, THE ASSIGNEE WILL REGULARLY CONTACT COMMUNITY LEADERS IN THE BARNEGAT LIGHT AREA, IN PERSON AND/OR BY TELEPHONE AND E-MAIL, TO ASCERTAIN AND ADDRESS ISSUES OF PUBLIC CONCERN WITHIN THE COVERAGE AREA. A TOLL-FREE TELEPHONE NUMBER WILL BE AVAILABLE TO THE RESIDENTS OF BARNEGAT LIGHT AND THE SURROUNDING AREA, AND THAT NUMBER WILL BE PUBLISHED IN THE LOCAL TELEPHONE DIRECTORY. THE RESULTS OF THE CONTACTS MADE IN THESE WAYS WILL BE REFLECTED IN PROGRAMMING AIRED ON THE STATION. SOME OR ALL OF THE STATION'S PROGRAMMING MAY BE SEPARATE AND DISTINCT FROM WVBV'S IN ORDER TO BETTER MEET LOCAL NEEDS AND INTERESTS. THE PUBLIC FILE WILL BE MAINTAINED IN ACCORDANCE WITH FCC RULES.

THE COMMISSION HAS REPEATEDLY RECOGNIZED THE BENEFITS OF CENTRALIZED OPERATIONS FOR NCE STATIONS, GIVEN THEIR LIMITED FUNDING, AND THUS HAS FOUND THAT GOOD CAUSE EXISTS TO WAIVE THE MAIN STUDIO RULE WHERE SATELLITE OPERATIONS ARE PROPOSED, PROVIDED THAT THOSE OPERATIONS SATISFY THE SECTION 73.1125 PUBLIC INTEREST STANDARD. ACCORDINGLY, BASED ON THE FOREGOING SHOWING AND COMMITMENTS, THE ASSIGNEE HEREBY REQUESTS THAT THE COMMISSION FIND PURSUANT TO SECTION 73.1125(B)(2) OF THE RULES THAT THE PUBLIC INTEREST WILL BE SERVED BY OPERATION OF THE PROPOSED STATION AS A SATELLITE OF WVBV WITH ITS MAIN STUDIO LOCATED IN MARLTON, NEW JERSEY.
