EXPLANATION OF STA REQUEST

BLACK MEDIA WORKS, INC. ('BMW') REPORTED BACK IN MARCH 2008 THAT IT LOST ITS LEASE FOR ITS LICENSED SITE WHEN THE TOWER OWNER SOLD ITS TOWER. AT THE TIME, STATION WJFP HAD A CONSTRUCTION PERMIT FOR A NEW SITE AND PLANNED TO INSTALL ITS ANTENNA ON AN EXISTING STRUCTURE. (BPED-19990727IA, GRANTED 12/17/2007). HOWEVER, THERE WAS ALREADY AN ANALOG TV ANTENNA AT THE EXACT LOCATION ON THE TOWER WHICH WAS SCHEDULED TO BE REMOVED AFTER THE 2009 DIGITAL CONVERSION OCCURRED. IN THE MEANTIME, BMW WAS PERMITTED TO INSTALL A TEMPORARY 2-BAY ANTENNA (INSTEAD OF THE AUTHORIZED 10-BAY ANTENNA) AT A LOWER HEIGHT ON THE TOWER WITH NON-DA FACILITIES. (SEE BSTA-20080326AFN). THE STA WAS GRANTED ON MARCH 27, 2008 AND WITH SEVERAL EXTENSIONS, WJFP HAS BEEN OPERATING WITH THESE TEMPORARY FACILITIES SINCE THEN.

HOWEVER, THE TOWER OWNER HAS NOT REMOVED THE ANALOG TV ANTENNA, AS RECITED IN THE PREVIOUS STA EXTENSION REQUESTS, BECAUSE A SUBSEQUENT STRUCTURAL ANALYSIS REVEALED THAT THE STRUCTURE DID NOT COMPLY WITH THE FLORIDA CODE. THE TOWER OWNER HAD ASSURED BMW THAT IT WOULD DISMANTLE THE EXISTING TOWER AND CONSTRUCT A NEW TOWER AT THE EXISTING LOCATION. HOWEVER, DESPITE THESE ASSURANCES OVER THE COURSE OF SEVERAL YEARS, CONSTRUCTION DID NOT OCCUR.

BMW WAS FORCED TO REFILE ITS CONSTRUCTION PERMIT APPLICATION FOR THE SAME FACILITIES (BPED-20100618AWZ) AND SINCE THAT PERMIT IS EXPIRING, BMW WILL BE FILING ANOTHER CONSTRUCTION PERMIT APPLICATION FOR A NEW 3 YEAR PERIOD WITHIN THE NEXT WEEK. AGAIN BMW HAS BEEN RECENTLY ASSURED THAT THE EXISTING TOWER WILL BE DISMANTLED AND A NEW TOWER CONSTRUCTED IN THE NEAR FUTURE. ALTHOUGH BMW FILED FOR STA EXTENSIONS INITIALLY, IT FAILED TO CONTINUE TO FILE FOR THESE EXTENSIONS AFTER THE LAST PERMIT WAS ISSUED. THIS FAILURE WAS INADVERTENT. BMW THOUGHT IT WOULD BE INSTALLING ITS ANTENNA ON THE NEW STRUCTURE BASED ON THE ASSURANCES IT RECEIVED. WITH THE REFILING OF THE APPLICATION, IT REALIZED ITS FAILURE TO CONTINUE TO FILE FOR EXTENSIONS AND THEREFORE IS FILING THIS NEW STA REQUEST.

AT THIS TIME, WJFP(FM), FORT PIERCE, FL (FACILITY ID: 5488), REQUESTS SPECIAL TEMPORARY AUTHORITY (STA) TO OPERATE WITH PARAMETERS IDENTICAL TO THAT OF THE PREVIOUSLY GRANTED SPECIAL TEMPORARY AUTHORITY (BSTA-20080326AFN). THE REQUESTED STA PARAMETERS OF 0.75 KW AT 121 METERS AMSL CONTINUE TO FALL WHOLLY WITHIN THE WJFP(FM) LICENSE AND AUTHORIZED CONSTRUCTION PERMIT VALUES AS NOTED IN THE ATTACHED EXHIBIT. THE SPECIAL TEMPORARY AUTHORITY TRANSMITTER POWER OUTPUT (TPO) HAS BEEN CALCULATED TO BE 1.1 KW BASED OFF OF A TOTAL OF 430 FT OF 7/8 INCH FOAM LINE AND THE OPERATING PARAMETERS NOTED ABOVE.
