STA REQUEST TO OPERATE SOLELY ON AUXILIARY

SINCE 2010 WLLJ HAS BEEN IN A DISPUTE WITH THE OWNER OF OUR TOWER FOR USAGE. IN 1998 FRIENDSHIP BCSTG SOLD ITS TOWER TO MAGUIRE COMCO, WHO IN 1999 SOLD IT TO SBA TOWERS. THE UNDERSTANDING WAS THAT FRIENDSHIP WAS TO RECEIVE FREE RENT UNTIL THE TOWER BALANCE WAS PAID. THE BALANCE WAS NEVER PAID AT ALL AND FOR 12 YEARS FRIENDSHIP RECEIVED FREE RENT. FOR SOME REASON IN 2010 SBA BEGAN DEMANDING BACK RENT SINCE 1999 AND A TOWER RENTAL OF $500 PER MONTH, LATER REQUESTING $2,000 PER MONTH. THE AVERAGE IN THIS AREA IS $700-$1000 PER MONTH, SBA'S OFFER NEARLY DOUBLE. THE DISPUTE LASTED FOR YEARS AND IN NOVEMBER 2013 SBA AND FRIENDSHIP WERE IN MCMINN COUNTY COURT TO SETTLE THE DISPUTE. THE JUDGE DECIDED THAT FRIENDSHIP OWED NO BACK RENT BUT THAT SBA HAD RIGHTS TO THE TOWER AND COULD EVICT US. THEREFORE FRIENDSHIP MUST VACATE THERE IS NO NEGOTIATION ON SBAS BEHALF. EXCEPT FOR MONTHS, AND ON A MONTHLY BASIS, SBA AGREED TO ALLOW FRIENDSHIP ON THE TOWER FOR AN OUTRAGEOUSLY EXPENSIVE SUM OF $2,000 PER MONTH UNTIL AND AUXILIARY COULD BE BUILT AND OPERATED. AS A RESULT WE WERE EXPECTING PERHAPS TO NEGOTIATE FURTHER WITH SBA AND EVEN OFFERED TO BUY THE TOWER, AS SBA HAD PLANNED TO ABANDON THE SITE ANYWAY. SBA REFUSED EVEN THOUGH OUR PURCHASE WOULD SAVE THEM THE EXPENSE TO DISMANTLE THE TOWER. THE AUXILIARY IS BUILT AND LICENSED AND FRIENDSHIP IS FORCED TO VACATE THE TOWER OF ITS MAIN FACILITY IN ATHENS, TN (BLH19890814KF, HAAT 150 M, 50 KW ERP, 418 M COR AMSL, 35-27-24/84-40-43)AND OPERATE SOLELY ON ITS AUXILIARY UNTIL A NEW MAIN SITE CAN BE LOCATED AND BUILT. THE AUXILIARY IS WLLJ AXC BXLH-20140721AEH, 35-11-32/84-33-32, 643 M HAAT, COR AMSL 982 M, 1.85 KW ERP DA. THE AUXILIARY IS LICENSED AND OPERATIONAL AND IT IS NECESSARY TO OPERATE THE AUXILIARY UNTIL A NEW SITE CAN BE BUILT. WE ARE A SMALL COMPANY AND SUCH A TASK AS THIS IS MONUMENTAL, WLLJ LOSING ITS MAIN TRANSMISSION SITE SINCE 1987. FIRST WE MUST ENGINEER AN AREA TO LOCATE, FIND POTENTIAL PROPERTY, NEGOTIATE WITH THE OWNERS, FILE FAA AND FCC APPLICATIONS MEETING ALL CRITERIA, AFTER APPROVAL STRUCTURE FINANCING TO BUILD THE TOWER, THEN CONSTRUCTION, WHICH WE WILL DO OURSELVES BUYING USED STEEL. THIS MAY REQUIRE AN EXTENDED PERIOD OF TIME AND WE MUST EXECUTE ALL OF THIS OURSELVES, AS WE ARE A SMALL RURAL RADIO STATION. SBA IS A LARGE TOWER CONGLOMERATE IN COMPARISON. THOUGH WE FEEL THE LEGAL RESULT WAS UNFAIR WE HAVE NO CHOICE BUT TO VACATE AND OPERATE ON THE AUXILIARY UNTIL FURTHER NOTICE. WE WILL WORK AS QUICKLY AS POSSIBLE TO LOCATE A NEW SITE FOR THE MAIN WHICH WOULD HAVE A SUPERIOR SIGNAL THAN THAT OF AN AUXILIARY. THEREFORE WE SEEK THIS STA TO OPERATE SOLELY ON THE AUXILIARY TILL FURTHER NOTICE AS WHEN WE CAN BUILD A NEW MAIN SITE. I HAVE INCLUDED IN THIS STA REQUEST THE AUXILIARY DATA WHICH ALREADY HAS BEEN LICENSED. IT IS PROVIDED HERE TO FILL IN THE BLANKS.

EXPLANATION OF STA NEED

FRIENDSHIP RESPECTFULLY ASKS THE FCC FOR PERMISSION, THIS REQUEST OF EXTENSION OF THE STA TO OPERATE ON OUR AUXILIARY ALONE FOR A TERM UNTIL A NEW MAIN SITE CAN BE BUILT. WJLJ WAS FORCED OFF ITS MAIN SITE IN 2014 BY SBA TOWERS BY A DECISION ON A DISPUTE IN A LEGAL COURT PROCEEDING. WE HAD SOLD THE TOWER IN 1998 TO MAGUIRE COMCO WITH THE CONTRACT TO INCLUDE FREE RENT UNTIL THE TOWER SUM FROM THE SALE WAS PAID. THE NEW OWNER SOLD THE TOWER TO ANOTHER PARTY AND FAILED TO ACCOMMODATE OUR AGREEMENT BY CONTRACT AND FAILED TO PAY US FOR THE TOWER AS WELL. THE NEW OWNERS OF THE TOWER, SBA, EVICTED US FROM THE PREMISES IN 2014. AS THE FCC IS AWARE WE HAVE BUILT AND LICENSED AN AUXILIARY FACILITY AND ARE PURSUING TO CONSTRUCT A NEW MAIN SITE. WE HAVE A TARGET AREA OF WHERE THE TOWER NEEDS TO LOCATE AND HAVE BEEN CONTACTING PROPERTY OWNERS IN THE AREA OF THE NEED, IN A RURAL AREA. HOWEVER, THE POTENTIAL SITES ARE NEAR INTERSTATE 75 WHERE PROPERTY VALUES ARE EXPENSIVE. FURTHERMORE THE HILL TOP WHERE WE PROPOSE TO LOCATE IS A RIGHT-OF-WAY FOR A INDUSTRIAL CROSS COUNTRY PIPELINE, MAKING LOCATION EVEN MORE DIFFICULT TO LOCATE A TOWER ON ANY PROPERTY. FRIENDSHIP BEGAN THE TASK OF LOCATING POTENTIAL SITES, HAVING DISCUSSIONS WITH PROPERTY OWNERS OF POTENTIAL SITES WITH NO SUCCESS AS YET. WE MUST REMAIN ON THE AIR DURING THIS PROCESS. THE SEARCH FOR NEW PROPERTY FOR A TOWER TO CONSTRUCT IS A DIFFICULT TASK AND TIME CONSUMING. WITHOUT A BROADCAST FACILITY THERE WOULD BE NO INCOME AND NO POSSIBILITY TO STRUCTURE A DEAL FOR A NEW TOWER. WE HAVE INVESTIGATED THE POSSIBILITY OF RENTING SPACE ON EXISTING TOWERS BUT THE MODIFICATIONS TO THE EXISTING TOWERS IN ORDER TO MOUNT THE ANTENNA ARE PROHIBITIVE AND TOO EXPENSIVE FOR OUR BUDGET. AND THE POTENTIAL EXISTING TOWERS WOULD NOT PRODUCE THE OPTIMUM SIGNAL OR LOCATED IN AREAS NOT MEETING SPACING REQUIREMENTS. ALL OTHER EXISTING TOWERS IN THE AREA ARE EITHER MINIMUM IN HEIGHT OR LOCATED IN AN AREA WHERE THE FACILITY CANNOT LOCATE, ETC. THEREFORE IT IS NECESSARY TO PURSUE BUILDING A NEW TOWER OF REASONABLE HEIGHT TO LOCATE THE MAIN ANTENNA IN THE PROPER PLACE. THIS TEMPORARY RELIEF MAY NEED AN EXTENDED PERIOD OF TIME SINCE OUR SMALL RURAL FACILITY HAS A MINIMUM STAFF AND FUNDING AND SINCE PROPERTY LOCATION IN THIS AREA IS AN ARDUOUS TASK. WE EXPECT THE PROCESS OF BUILDING A NEW TOWER WILL REQUIRE AN EXTENDED PERIOD OF TIME, SINCE WE ARE SEEING THAT LOCATING A NEW TOWER SITE HAS BECOME MORE DIFFICULT OVER THE YEARS. WE ARE IN AN EMERGENCY STATE IN ORDER TO REMAIN ON THE AIR. WJLJ HAS A UNIQUE CHRISTIAN CONTEMPORARY MUSIC FORMAT AND WE SERVE SMALL RURAL COMMUNITIES WITH MUCH PUBLIC SERVICE, LIVE EVENTS AND COMMUNITY AIMED PROGRAMMING WHICH IS VERY LOCAL TO THE TENNESSEE VALLEY. THERE ARE A LIMITED NUMBER OF LOCAL VOICES IN THE AREA AND WE ARE A REGIONAL C2 FACILITY, THE MOST POWERFUL IN THE AREA. THE PUBLIC HERE NEEDS OUR SIGNAL AND WE ASK FOR THIS PERMISSION AS QUICKLY AS POSSIBLE. WE DESIRE AND INTEND TO BUILD A NEW MAIN FACILITY AS SOON AS HUMANLY POSSIBLE, USING THE AUXILIARY IN THE FUTURE FOR EMERGENCY SITUATIONS AND FOR MAINTENANCE PERIODS OF A MAIN FACILITY. A NEW MAIN FACILITY WOULD HAVE A MORE SUPERIOR SIGNAL COVERAGE THAN OUR PRESENT AUXILIARY MOTIVATING US TO MOVE AS QUICKLY AS POSSIBLE.
