ENVIRONMENTAL PROCESSING

THIS STA REQUEST PROPOSES OPERATION FROM AN EXISTING REGISTERED TOWER (ASR #1007008). THE TOWER CURRENTLY CONTAINS NO OTHER ANTENNAS AND NO NEW CONSTRUCTION IS PROPOSED OTHER THAN MOUNTING THE KQQX ANTENNA ON THE TOWER.

APPLICANT HAS DETERMINED, USING FCC/OET FMM210 SOFTWARE, THAT NO MEMBERS OF THE GENERAL PUBLIC WILL BE EXPOSED AT ANY POINT ON THE GROUND TO A RADIATION LEVEL EXCEEDING 0.2 MW/CM2, THE MAXIMUM LEVEL ALLOWED UNDER OET 65 GUIDELINES. APPLICANT WILL LOWER ITS TRANSMITTER POWER AS NECESSARY TO LIMIT EXPOSURE TO WORKERS ON THE TOWER TO LESS THAN 1.0 MW/CM2, THE MAXIMUM RADIATION LEVEL ALLOWED FOR WORKERS UNDER OET 65 GUIDELINES.

CIRCUMSTANCES WARRANTING APPROVAL OF STA REQUEST

IN SEPTEMBER 2014, THE LICENSEE COMMENCED BROADCASTING AND FILED ITS STATION LICENSE APPLICATION TO COVER THE CONSTRUCTION PERMIT ISSUED TO KQQX FOR ITS COMMUNITY RELOCATION TO HERMANN, MISSOURI (BLH-20140908AFI). ON OCTOBER 2, STATION KQQX HAD TO GO SILENT AS A RESULT OF INCONSISTENT INFORMATION PROVIDED BY LOCAL AUTHORITIES. INITIALLY, THE LICENSEE WAS TOLD THAT TOWERS LESS THAN 200 FEET IN HEIGHT WERE EXCEPTED FROM LOCAL REQUIREMENTS, BUT, SUBSEQUENT TO OBTAINING ITS CONSTRUCTION PERMIT, THOSE REQUIREMENTS APPARENTLY CHANGED.

THE LICENSEE COMMENCED SEARCHING FOR A SITE FROM WHICH IT COULD CONSTRUCT A LARGER TOWER. IT UNSUCCESSFULLY EXPLORED SEVERAL ALTERNATIVE SITES BEFORE, RECENTLY, LOCATING AN ACCEPTABLE SITE. ITS CONSULTANT WILL BE SEEKING FAA APPROVAL FOR THAT SITE AND AN APPLICATION WILL BE FILED WITH THE FCC AS SOON AS FAA AIR HAZARD APPROVAL IS RECEIVED.

BECAUSE OF THE LENGTH OF FAA AIR HAZARD APPROVAL PROCEDURES AS WELL AS LOCAL CONSTRUCTION PROCESS APPROVAL, IT IS NECESSARY THAT STATION KQQX OPERATE IMMEDIATELY FROM A TEMPORARY SITE. THEREFORE, THIS STA REQUEST IS BEING FILED ASKING FOR COMMISSION APPROVAL TO OPERATE FROM AN EXISTING TOWER WHILE THE STATION GOES THROUGH THE APPROVAL PROCESS FOR ITS PROPOSED TOWER.

THIS STA REQUEST HAS BEEN PREPARED AND REVIEWED BY AN EXPERIENCED ENGINEERING CONSULTANT, WHO HAS DETERMINED THAT THE PROPOSED TEMPORARY FACILITIES MEET ALL FCC TECHNICAL REQUIREMENTS. BECAUSE STATION KQQX HAS BEEN SILENT SINCE OCTOBER 2, 2014, WE RESPECTFULLY REQUEST EXPEDITED CONSIDERATION OF THIS STA REQUEST.
