ENVIRONMENTAL PROCESSING

THIS STA REQUEST PROPOSES CONTINUED OPERATION FROM AN EXISTING REGISTERED TOWER (ASR #1007008).

IN ITS PREVIOUS STA REQUEST, THE STATION EXPLAINED THAT IT HAS DETERMINED, USING FCC/OET FMM210 SOFTWARE, THAT NO MEMBERS OF THE GENERAL PUBLIC WILL BE EXPOSED AT ANY POINT ON THE GROUND TO A RADIATION LEVEL EXCEEDING 0.2 MW/CM2, THE MAXIMUM LEVEL ALLOWED UNDER OET 65 GUIDELINES. APPLICANT WILL LOWER ITS TRANSMITTER POWER AS NECESSARY TO LIMIT EXPOSURE TO WORKERS ON THE TOWER TO LESS THAN 1.0 MW/CM2, THE MAXIMUM RADIATION LEVEL ALLOWED FOR WORKERS UNDER OET 65 GUIDELINES.

CIRCUMSTANCES WARRANTING EXTENSION OF EXISTING STA

IN SEPTEMBER 2014, THE LICENSEE COMMENCED BROADCASTING AND FILED ITS STATION LICENSE APPLICATION TO COVER THE CONSTRUCTION PERMIT ISSUED FOR KQQX TO CHANGE ITS COMMUNITY OF LICENSE TO HERMANN, MISSOURI. HOWEVER, SHORTLY THEREAFTER, LOCAL AUTHORITIES NOTIFIED THE STATION THAT, DUE TO CHANGED ZONING REQUIREMENTS, THE STATION COULD NO LONGER USE THAT TOWER. KQQX HAD NO CHOICE BUT TO GO SILENT TEMPORARILY, AND IT BEGAN ITS SEARCH FOR A NEW PERMANENT TOWER SITE.

BECAUSE OF LOCAL ZONING RESTRUCTIONS, IT BECAME INCREASINGLY DIFFICULT TO LOCATE A SITE FROM WHICH A TOWER OF ANY SIZE COULD BE CONSTRUCTED. AS SUCH, KQQX AGREED TO LEASE SPACE ON AN EXISTING SMALLER TOWER, WHICH ALLOWED IT TO BROADCAST TEMPORARILY PURSUANT TO AN STA, WHICH THE FCC APPROVED IN SEPTEMBER 2015.

SINCE THAT TIME, KQQX HAS CONTINUED ITS SEARCH FOR A NEW SITE, WHICH WOULD RECEIVE LOCAL APPROVAL. KQQX BELIEVES THAT IT HAS LOCATED SUCH A SITE. PLUS, IT APPEARS THAT LOCAL ZONING RESTRUICTIONS ARE IN THE PROCESS OF BEING RELAXING.

AS NOTED, FAA AIR HAZARD APPROVAL MUST BE OBTAINED AS WELL AS LOCAL ZONING APPROVAL. DURING THE TIME THAT THESE APPROVALS ARE SOUGHT, STATION KQQX WOULD LIKE TO CONTINUE TO OPERATE FROM ITS STA ANTENNA SITE. THE STA SITE IS NOT OPTIMUM; HOWEVER, IT PERMITS KQQX TO OPERATE WHILE THE STATION GOES THROUGH NECESSARY APPROVAL PROCEDURES. STATION KQQX,THEREFORE, REQUESTS AN EXTENSION OF ITS CURRENT FCC ENGINEERING STA (BSTA-20150916ADW).
