RFR STATEMENT OF COMPLIANCE

BASED ON THE FCC'S FM MODEL PROGRAM, WHICH CONSIDERS THE SPECIFIC ANTENNA TYPE AND PREDICTS THE POWER DENSITY AT TWO METERS ABOVE GROUND LEVEL, THE WNBT-FM TEN BAY, OPPOSED 'V' DIPOLE TYPE, FULL-WAVE SPACED FM ANTENNA (EPA TYPE 2) IS PREDICTED TO PRODUCE A MAXIMUM WORST-CASE POWER DENSITY OF 166 MICROWATTS PER SQUARE CENTIMETER AT TWO METERS ABOVE GROUND LEVEL.

BASED ON THE CALCULATIONS DISCUSSED ABOVE, THE PREDICTED POWER DENSITY REPRESENTS ONLY 83% OF THE FCC GUIDELINE VALUE FOR UNCONTROLLED RFR ENVIRONMENTS.

FURTHER, THE APPLICANT IS COMMITTED TO REDUCING POWER AND/OR CEASING OPERATION DURING TIMES OF SERVICE OR MAINTENANCE OF THE TRANSMISSION SYSTEMS AS NECESSARY TO AVOID POTENTIALLY HARMFUL EXPOSURE TO PERSONNEL. IN LIGHT OF THE ABOVE, THE PROPOSED FACILITY SHOULD BE CATEGORICALLY EXCLUDED FROM RF ENVIRONMENTAL PROCESSING UNDER SECTION 1.1307(B) OF THE COMMISSION'S RULES.

CIRCUMSTANCES REQUIRING STA

RECENTLY, THE APPLICANT ACQUIRED WNBT-FM IN ACCORDANCE WITH ASSIGNMENT OF LICENSE APPLICATION FCC FILE NO. BAL-20160428ABC, GRANTED 7/5/16 AND CONSUMMATED 8/1/16. DURING AN EFFORT TO UPGRADE THE STATION'S DATED TRANSMISSION SYSTEM, IT WAS DISCOVERED THAT THE WNBT-FM SUPPORT STRUCTURE IS ONLY 60 METERS ABOVE GROUND LEVEL (AGL). THE WNBT-FM ANTENNA IS PRESENTLY LICENSED AT AN ANTENNA HEIGHT OF 67 METERS AGL.

IN LIGHT OF THE ABOVE, THE APPLICANT HEREIN REQUESTS STA TO CONTINUE TO OPERATE WNBT-FM AT THIS LOWER ANTENNA HEIGHT UNTIL THE APPLICANT IS ABLE TO FINALIZE, APPLY FOR, RECEIVE AUTHORIZATION FOR, AND IMPLEMENT THE UPGRADED TRANSMISSION SYSTEM AND TOWER REFURBISHMENT PROJECT. THE TECHNICAL DETAILS OF THE WNBT-FM OPERATION ARE AS FOLLOWS:

ANTENNA: PHELPS DODGE/JAMPRO 10-BAY, FULL-WAVE SPACED
POWER GAIN = 5.5
203 FEET OF 1-5/8 INCH AIR TRANSMISSION LINE

AT THE LOWER ANTENNA HEIGHT SPECIFIED HEREIN, IT FOLLOWS THAT THE PROPOSED STA FACILITY WILL NEITHER EXTEND THE WNBT-FM COVERAGE NOR INCREASE THE WNBT-FM INTERFERENCE POTENTIAL IN COMPARISON TO THE LICENSED WNBT-FM TECHNICAL FACILITY.

ACCORDINGLY, THE APPLICANT REQUESTS SPECIAL TEMPORARY AUTHORITY TO OPERATE WNBT-FM AS DESCRIBED HEREIN FOR A PERIOD OF 180 DAYS.
