EXTRAORDINARY CIRCUMSTANCES WHICH WARRANT TEMPORARY OPERATIONS

COMMONWEALTH BROADCASTING LLC ('COMMONWEALTH'), RESPECTFULLY REQUESTS AN EXTENSION OF THE KXTS(FM), GEYSERVILLE, CALIFORNIA, SPECIAL TEMPORARY AUTHORIZATION ('STA') TO PERMIT CONTINUED OPERATION FROM A TEMPORARY SITE WHILE REBUILDING ITS LICENSED FACILITIES, PURSUANT TO SECTION 73.1635 OF THE COMMISSION'S RULES.

AS REPORTED IN NOVEMBER 2019, THE KXTS FACILITIES WERE DESTROYED BY RAGING WILDFIRES, FORCING COMMONWEALTH TO MOVE KXTS AND OPERATE FROM A TEMPORARY LOCATION. THE TECHNICAL SPECIFICATIONS OF THIS TEMPORARY SITE WERE PROVIDED IN ITS ORIGINAL REQUEST FOR A STA.

SINCE NOVEMBER 2019, COMMONWEALTH HAS BEEN DILIGENTLY WORKING TOWARD RECONSTRUCTION OF THE KXTS LICENSED FACILITIES. PROGRESS MADE INCLUDES:

1) COMPLETELY CLEARING THE SITE OF BURNED OUT AND MELTED DEBRIS;
2) APPLYING FOR AND OBTAINING A BUILDING PERMIT FROM SONOMA COUNTY TO REBUILD;
3) ORDERING THE NEW TRANSMITTERS AND MASTER ANTENNA SYSTEM;
4) DESIGNING AND LAYING OUT THE REPLACEMENT TRANSMITTER BUILDING (20 FOOT SHIPPING CONTAINER); AND,
5) COMPLETING A SET OF COMPUTER AIDED DESIGN DRAWINGS FOR USE BY THE MANUFACTURER THAT IS FITTING THE REPLACEMENT BUILDING/CONTAINER.

FURTHER, COMMONWEALTH ENTERED INTO AN AGREEMENT WITH A GENERAL CONTRACTOR TO TAKE CARE OF THE SITE PREPARATION WORK (SILT FENCING, EXCAVATIONS, CONCRETE BUILDING SUPPORT PIERS, COMPACTIONS, GRADING, ETC.)

UNFORTUNATELY, EXTREMELY WET WEATHER IN THE WINTER AND EARLY SPRING MADE SITE WORK IMPOSSIBLE. THIS COMBINED WITH THE UNEXPECTED OUTBREAK OF THE CORONAVIRUS SLOWED PROGRESS CONSIDERABLY AS COMMONWEALTH SHIFTED ITS FOCUS TO THE MANY ADJUSTMENTS NECESSARY TO SAFELY CONDUCT BUSINESS DURING THE PANDEMIC. ALTHOUGH DELAYED, COMMONWEALTH PLANS TO CONTINUE ITS EFFORTS TO RECONSTRUCT ITS LICENSED FACILITIES AS SOON AS PRACTICABLE.

ACCORDINGLY, COMMONWEALTH RESPECTFULLY REQUESTS AN EXTENSION OF THE KXTS STA TO OPERATE FROM ITS TEMPORARY SITE UNTIL RECONSTRUCTION OF ITS LICENSED FACILITIES IS COMPLETED AND IT CAN RESUME BROADCASTING FROM ITS LICENSED SITE.
