Section 1.1306 (i.e., The facility will not have a significant environmental impact and complies with the maximum permissible radiofrequency electromagnetic exposure limits for controlled and uncontrolled environments). Unless the applicant can determine compliance through the use of the RF worksheets in Appendix A, an Exhibit is required.

EXTRAORDINARY CIRCUMSTANCES WHICH WARRANT TEMPORARY OPERATIONS

COMMONWEALTH BROADCASTING LLC ('COMMONWEALTH'), RESPECTFULLY REQUESTS A FURTHER EXTENSION OF THE KXTS(FM) SPECIAL TEMPORARY AUTHORIZATION ('STA') TO PERMIT CONTINUED OPERATION FROM A TEMPORARY SITE WHILE REBUILDING ITS LICENSED FACILITIES, PURSUANT TO SECTION 73.1635 OF THE COMMISSION'S RULES.

THE KXTS FACILITIES WERE DESTROYED BY RAGING WILDFIRES, FORCING COMMONWEALTH TO MOVE KXTS AND OPERATE FROM A TEMPORARY LOCATION. THE TECHNICAL SPECIFICATIONS OF THIS TEMPORARY SITE WERE PROVIDED IN ITS ORIGINAL REQUEST FOR A STA.

COMMONWEALTH HAS CONTINUED TO DILIGENTLY RECONSTRUCT THE KXTS LICENSED FACILITIES AND IS PLEASED TO REPORT THAT SUBSTANTIAL PROGRESS HAS BEEN MADE SINCE ITS LAST SUBMISSION:

1) THE BUILDING IS IN PLACE;
2) TRANSMITTERS AND OTHER EQUIPMENT ARE IN PLACE;
3) THE MASTER ANTENNA COMBINER IS IN PLACE; AND,
4) THE TRANSMISSION LINE AND ANTENNA ARE ON SITE.

IT IS IMPORTANT TO NOTE THAT KEY MOUNTING HARDWARE/BRACKETS WERE NOT INCLUDED WITH THE ANTENNA SHIPMENT, WHICH DELAYED FURTHER CONSTRUCTION. DESPITE THIS MINOR SETBACK, THE LOCAL ENGINEER EXPECTS TO COMPLETE THIS PROJECT BEFORE CHRISTMAS, BARRING ANY UNFORESEEN COMPLICATIONS.

ACCORDINGLY, COMMONWEALTH RESPECTFULLY REQUESTS A FURTHER EXTENSION OF THE KXTS STA TO PERMIT CONTINUED OPERATATION FROM ITS TEMPORARY SITE UNTIL RECONSTRUCTION OF ITS LICENSED FACILITIES IS FINISHED AND IT CAN RESUME BROADCASTING FROM ITS LICENSED SITE.
