IN THE STATEMENT, MARTIN D. HADFIELD, VP-ENGINEERING, ENTERCOM STATED ' I HAVE EXAMINED THE COMMISSIONS' ENVIRONMENTAL REQUIREMENTS IN 47 CFR 1.1307. BASED UPON MY COMPUTATION USING THE FCC FM MODEL, VERSION 2.10 BETA, POWER DENSITY COMPUTER PROGRAM, I HAVE DETERMINED THAT THE PROPOSED ELECTRONICS RESEARCH INC. TEN BAY CIRCULARLY POLARIZED COGWHEEL ANTENNA CONFIGURATION, DOES NOT HAVE A SIGNIFICANT ENVIRONMENTAL IMPACT AS DEFINED BY SECTION 1.1307, WHICH INCLUDES CONSIDERATION OF THE EXPOSURE OF WORKERS OR THE GENERAL PUBLIC TO LEVELS OF RADIO FREQUENCY RADIATION EXCEEDING IDENTIFIED GUIDELINES ISSUED BY THE AMERICAN NATIONAL STANDARDS INSTITUTE (ANSI/IEEE C95.1-1992, 'STANDARD FOR SAFETY LEVELS WITH RESPECT TO HUMAN EXPOSURE TO RADIO FREQUENCY ELECTROMAGNETIC FIELDS, 3KHZ TO 300GHZ'). ACCESS TO THE SITE IS RESTRICTED AND THERE IS NO GENERAL PUBLIC EXPOSURE ABOVE THE FCC RF RADIATION LIMIT. THE TOWER BASE IS ADEQUATELY FENCED AND SECURELY GATED WITH APPROPRIATE WARNING SIGNS POSTED. BECAUSE THE ERI COGWHEEL ANTENNA INTENDED FOR USE BY KUDL DOES NOT HAVE AN ASSOCIATED ELEMENT PATTERN FOR USE WITH THE FM MODEL PROGRAM, A TYPE 1 ELEMENT PATTERN WAS USED, WHICH IS AN APPROPRIATE ELEMENT PATTERN FOR A 'WORST CASE' RING-STUB TYPE ANTENNA. BASED ON THIS, THE CALCULATED MAXIMUM 'PERCENTAGE OF FCC RF RADIATION LIMIT', GENERAL POPULATION OR UNCONTROLLED EXPOSURE, FOR THE INSTANT FACILITY IS <1.0% AT A DISTANCE OF APPROXIMATELY 40 METERS AWAY FROM THE ANTENNA SUPPORT STRUCTURE BASE. INSIDE THE FENCED SITE, THE MAXIMUM PREDICTED EXPOSURE LEVEL IS ALSO <1% OF THE CONTROLLED EXPOSURE GUIDELINE. WITH RESPECT TO 'ON TOWER' OR OTHER EXPOSURE TO WORKERS AT THE SITE, APPROPRIATE POWER REDUCTION OR CESSATION OF TRANSMITTER OPERATION WILL BE UNDERTAKEN BY THE LICENSEE AND OTHER SITE TENANTS.'    

IN RESPONSE TO SPECIAL OPERATING CONDITION OR RESTRICTION #6 IN THE ABOVE NOTED CONSTRUCTION PERMIT, THE PERMITTEE/LICENSEE WILL, IN COORDINATION WITH OTHER USERS OF THE SITE REDUCE POWER OR CEASE OPERATION AS NECESSARY TO PROTECT PERSONS HAVING ACCESS TO THE SITE, TOWER OR ANTENNA FROM RADIOFREQUENCY ELECTROMAGNETIC FIELDS IN EXCESS OF FCC GUIDELINES.
