REQUEST FOR WAIVER OF FILING FEE

BY THE INSTANT APPLICATION, KAZT, L.L.C., LICENSEE OF CLASS A STATION KAZT-CA, PHOENIX, ARIZONA, PROPOSES TO MODIFY THE STATION TO ADD A POWER DIVIDER, WHICH WILL INCREASE THE LOSSES IN THE TRANSMISSION SYSTEM AND RESULT IN INCREASED TRANSMITTER POWER OUTPUT (TPO). THIS MODIFICATION WILL NOT RESULT IN ANY CHANGE IN ANTENNA OR EFFECTIVE RADIATED POWER (ERP).

PURSUANT TO THE COMMISSION'S RULES, THIS MODIFICATION MAY BE MADE WITHOUT PRIOR FCC AUTHORIZATION, SUBJECT TO THE FILING OF A MODIFICATION OF LICENSE APPLICATION ON FCC FORM 302-CA FOLLOWING COMMENCEMENT OF PROGRAM TEST OPERATIONS. SEE 47 CFR SECTION 73.1690(C)(10) (REQUIRING ONLY THE FILING OF A LICENSE MODIFICATION APPLICATION FOLLOWING 'REPLACEMENT OF A TRANSMISSION LINE ... WHICH CHANGES THE ... TPO FROM THE AUTHORIZED VALUE, BUT NOT THE ERP...'). ENVIRONMENTAL STATEMENT

GRANT OF THIS REQUEST WOULD NOT BE CONSIDERED A MAJOR ENVIRONMENTAL ACTION. NONE OF THE CONDITIONS SPECIFIED IN SECTION 1.1307(A) OF THE RULES ARE BELIEVED TO APPLY. CALCULATIONS PERFORMED IN ACCORDANCE WITH OET-65 INDICATE THAT THE EXISTING AND PROPOSED OPERATION OF KAZT-CA WOULD CONTRIBUTE 1.5% OF THE PUBLIC EXPOSURE LIMIT AT A CALCULATION HEIGHT OF 2 METERS ABOVE GROUND. THE PROPOSED OPERATION IS THEREFORE CATEGORICALLY EXCLUDED FROM HAVING TO CONSIDER OTHER FACILITIES AT THE SITE.
