EXPLANATION

WE HEREBY REQUEST A FURTHER EXTENSION OF SPECIAL TEMPORARY AUTHORITY TO MAINTAIN DIGITAL OPERATIONS AT REDUCED POWER CONSISTENT WITH THE POLICY SET FORTH BY THE COMMISSION IN MM DOCKET 00-39 (BY ORDER RELEASED NOVEMBER 15, 2001). THE COMMISSION PREVIOUSLY GRANTED LICENSEE TEMPORARY AUTHORITY TO OPERATE WITH DTV FACILITIES AT REDUCED POWER, SPECIFICALLY, WITH ERP OF 117 KW (SEE LETTER DATED APRIL 19, 2002, FILE NO. BDSTA-20020307ACZ). THAT AUTHORIZATION WAS RENEWED ON NOVEMBER 5, 2002 (FILE NO. BEDSTA-20021023ABP), ON JUNE 3, 2003 (FILE NO. BEDSTA-20030507ADH), ON DECEMBER 11, 2003 (FILE NO. BEDSTA-20031126AUO, ON JUNE 23, 2004 (FILE NO. BEDSTA-20040602ACV), AND ON JANUARY 12, 2005 (FILE NO. BEDSTA-20041220ACX). LICENSEE HEREBY REQUESTS LEAVE TO SUBMIT THIS LATE-FILED REQUEST FOR A FURTHER EXTENSION OF THE STA SO THAT DIGITAL OPERATIONS MAY CONTINUE AT REDUCED POWER UNTIL THE ANTICIPATED BEGINNING OF FULL POWER DIGITAL OPERATIONS ON OR BEFORE THE JULY 1, 2006, DEADLINE SET FORTH BY THE FCC. THE PUBLIC INTEREST FACTORS THAT SUPPORTED GRANT OF THE INITIAL AUTHORIZATION STILL OBTAIN. AS THE FCC HAS DETERMINED, GRANTING SUCH A REQUEST WILL FURTHER THE PUBLIC INTEREST IN A SMOOTH TRANSITION TO DIGITAL OPERATIONS.   LICENSEE ANTICIPATES NO NEED FOR STA BEYOND JULY 1, 2006. RATHER, LICENSEE REQUESTS THE MAXIMUM AVAILABLE EXTENSION OF THE STA THAT DOES NOT EXTEND PAST JULY 1, 2006.
