NMU'S PREVIOUS FORM 337 CP EXTENSION APPLICATION (FILE NO. BEPEDT-20070126ADJ) WAS GRANTED ON MAY 18, 2007 BY ORDER, FCC 07-91. THAT GRANT EXTENDED WNMU-DT'S CONSTRUCTION PERMIT (FILE NO. BMPEDT-20060628ACT) UNTIL NOVEMBER 18, 2007. ON NOVEMBER 13, 2007, NMU FILED A STILL-PENDING NEW FORM 337 APPLICATION (FILE NO. BEPEDT-20071113AEL) WHICH SEEKS A FURTHER CP EXTENSION UNTIL FEBRUARY 17, 2009, IN LIGHT OF WNMU-DT'S UNIQUE FACTUAL SITUATION AND THE COMMISSION'S RECENT DTV PRONOUNCEMENTS WHICH DIRECTLY AFFECT WNMU-DT.

SPECIFICALLY, AND MOST IMPORTANTLY, IN FOOTNOTE 2 OF ORDER, FCC 07-90, RELEASED MAY 18, 2007, THE COMMISSION STATED: 'IF ANY OF THESE STATIONS [LIKE WNMU-DT, WHICH FILED A 'USE OR LOSE' WAIVER REQUEST AND ALSO A CONSTRUCTION PERMIT EXTENSION REQUEST] RECEIVES AN EXTENSION OF ITS DTV CONSTRUCTION DEADLINE, IT WILL BE REQUIRED TO BUILD FACILITIES THAT MEET THE 'USE OR LOSE' OR 'CHECKLIST' REQUIREMENT BY THAT EXTENDED DATE, OR, IF PERMITTED, SEEK A FURTHER EXTENSION OF THE DTV CONSTRUCTION DEADLINE, WHICH IF, AND TO EXTENT, GRANTED WOULD ALSO OPERATE AS A WAIVER TO EXTEND THE 'USE OR LOSE' OR 'CHECKLIST' REQUIREMENT.

IN WNMU-DT'S CASE, NMU IS PHYSICALLY AND FISCALLY UNABLE TO BUILD ANY LICENSED DTV FACILITY UNTIL THE DTV TRANSITION OCCURS. THEREFORE, NMU IS SEPARATELY REQUESTING AN EXTENSION OF ITS CURRENT DTV CONSTRUCTION PERMIT UNTIL FEBRUARY 17, 2009. IN THE MEANTIME, WNMU-DT MUST CONTINUE TO OPERATE WITH ITS STA FACILITIES. THAT STA EXPIRES ON DECEMBER 28, 2007 AND HAS THE SAME SPECIFICATIONS AS WNMU-DT'S CURRENT CONSTRUCTION PERMIT (PERMIT FILE NO. BMPEDT-20060628ACT). THEREFORE, GOOD CAUSE EXISTS TO GRANT A FURTHER SIX-MONTH EXTENSION OF WNMU-DT'S CURRENT STA.
