JUSTIFICATION FOR EXTENSION

AS NOTED IN BESTA-20070802AED, THE ORIGINAL STA WAS GRANTED TO TO RELOCATE THE TRANSMITTER FROM A SITE ON CLINCH MOUNTAIN IN VIRGINIA TO A SITE ON BAYS MOUNTAIN IN TENNESSEE, AS PROPOSED IN BPTVL-20070208ABJ. AN STA WAS NEEDED TO PERMIT AN IMMEDIATE MOVE BECAUSE AN UNRELIABLE POWER SUPPLY AT THE LICENSED SITE HAD RESULTED IN THE STATION'S GOING DARK. THE STA IS FOR LOWER POWER THAN REQUESTED IN THE CONSTRUCTION PERMIT APPLICATION. BPTVL-20070208ABJ WAS GRANTED ON MARCH 6, 2007. THUS PERMANENT OPERATION AT THE STA SITE IS ULTIMATELY ASSURED.

THE FIRST EXTENSION REQUEST WAS BASED ON BUDGETARY CONSIDERATIONS, WHERE THE LICENSEE WAS PLANNING TO PURCHASE THE HIGHER POWERED TRANSMITTER TO IMPLEMENT THE PERMIT IN EARLY 2008. HOWEVER, THERE HAS NOW BEEN AN INTERVENING DEVELOPMENT, IN THAT THE COMMISSION HAS STATED THAT DURING THE FIRST QUARTER OF 2008, IT PLANS TO PROPOSE A MANDATORY DIGITAL CONVERSION SCHEDULE FOR LPTV STATIONS. THE LICENSEE WOULD LIKE TO SEE THAT PROPOSAL BEFORE COMMITTING TO PURCHASING A NEW ANALOG TRANSMITTER, SINCE IT MAY TURN OUT TO BE MORE BENEFICIAL TO APPLY TO FLASH CUT TO DIGITAL OPERATION AND BUY A DIGITAL TRANSMITTER.

THE CONSTRUCTION PERMIT ON WHICH THE STA IS BASED DOES NOT EXPIRE UNTIL MARCH 6, 2010, SO THERE IS NO ISSUE OF AN IMPENDING EXPIRATION DATE. ANOTHER SIX-MONTH EXTENSION OF THE EXISTING STA IS REQUESTED, TO ALLOW OPERATION AT THE CONSTRUCTION PERMIT SITE BUT AT REDUCED POWER, PENDING REVIEW OF THE UPCOMING DIGITAL TRANSITION PROPOSALS.

THE STATION IS CURRENTLY ON THE AIR AT REDUCED POWER UNDER THE EXISTING STA.
