EXH. 40 STA JUSTIFICATION; PROPOSED PERMANENT ANALOG REDUCTION COMPLIANCE

WBGU-TV, A NONCOMMERCIAL EDUCATIONAL TV STATION LICENSED TO BOWLING GREEN STATE UNIVERSITY (BGSU), NOTIFIED THE COMMISSION ON MARCH 6, 2008 THAT, DUE TO THE FAILURE OF ITS KLYSTRON TUBE ON FEBRUARY 26, 2008, WBGU-TV HAS BEEN REQUIRED TO OPERATE AT ONE-THIRD OF ITS AUTHORIZED POWER SINCE THAT DATE. WBGU-TV IS NOW REQUESTING SPECIAL TEMPORARY AUTHORITY TO CONTINUE REDUCED POWER OPERATION UNTIL FEBRUARY 17, 2009 OR AT LEAST FOR THE NEXT SIX MONTHS WITH THE STANDARD SIX-MONTH EXTENSION OPTION.

WBGU-TV'S CHIEF ENGINEER, MARK HENNING, MANAGED TO REPLACE WBGU-TV'S KLYSTRON TUBE WITH A USED ONE THAT WAS ON-HAND, BUT THE REPLACEMENT PART IS ONLY ABLE TO GENERATE AN ERP OF APPROXIMATELY 322 KILOWATTS, INSTEAD OF WBGU-TV'S AUTHORIZED ONE MEGAWATT ERP.

BECAUSE THIS CATASTROPHE HAPPENED UNEXPECTEDLY, AS BGSU EMBARKS ON ITS FINAL DTV TRANSITION, BGSU BELIEVES THAT, INSTEAD OF REQUESTING THE USUAL SIX-MONTH STA, IT IS NOW APPROPRIATE TO REQUEST AN STA FOR PERMANENT ANALOG POWER REDUCTION UNTIL FEBRUARY 17, 2009 -- ONLY 11 MONTHS FROM NOW -- PURSUANT TO PARAGRAPHS 107-117 OF THE THIRD PERIODIC REVIEW REPORT AND ORDER (TPRRO), RELEASED DECEMBER 31, 2007.

THE JUSTIFICATION FOR THIS REQUEST IS THAT ON MARCH 5, 2008, WBGU-DT WAS GRANTED A CONSTRUCTION PERMIT FOR ITS FINAL DTV TRANSITION (PERMIT FILE NO. BPEDT-20080225AHC), WBGU-DT IS IN THE PROCESS OF BEGINNING TO BUILD THAT FINAL DTV FACILITY, AND, AS A UNIVERSITY NONCOMMERCIAL PBS STATION, WBGU-DT MUST CONSERVE AS MUCH OF ITS LIMITED FINANCIAL RESOURCES AS POSSIBLE IN THE CONSTRUCTION PROCESS. BGSU HAS LEARNED THAT IT WOULD COST $50,000 FOR A NEW KLYSTRON TUBE, WHICH WOULD BE NECESSARY IN ORDER FOR WBGU-TV TO RESUME FULL-POWER OPERATION. WBGU-TV DID NOT BUDGET FOR SUCH AN UNANTICIPATED MAJOR EXPENSE, AND DIVERTING SO MUCH MONEY TO ITS ANALOG FACILITY NOW WILL IMPEDE ITS FINAL DTV BUILDOUT, AND SUCH EXTRA FUNDS MAY NOT BE AVAILABLE. THUS, BGSU RESPECTFULLY URGES THAT THE REQUESTED PERMANENT ANALOG REDUCTION IN POWER IS DIRECTLY RELATED TO WBGU-DT'S POST-TRANSITION CONSTRUCTION WITHIN THE MEANING OF PARAGRAPH 115(1) OF THE TPRRO.

BECAUSE THE NEED FOR AN STA AROSE CATASTROPHICALLY, BGSU HAS NOT COMMENCED AUDIENCE NOTIFICATION OF ANALOG REDUCTION 60 DAYS IN ADVANCE, AS REQUIRED BY PARAGRAPH 117 OF THE TPRRO. BGSU WILL BEGIN SUCH POST-HOC EXPLANATORY NOTIFICATION IMMEDIATELY, IF THIS SPECIAL STA REQUEST IS GRANTED.

FINALLY, AS TO NUMBER OF VIEWERS AFFECTED BY THE PROPOSED PERMANENT ANALOG POWER REDUCTION, BGSU HAS APPENDED THREE CONTOUR COVERAGE MAPS PREPARED BY JOHN F.X. BROWNE AND ASSOCIATES, P.C. THE THIRD MAP DEMONSTRATES THAT MOST OF WBGU-TV'S PREDICTED AUDIENCE LOSS AREAS UNDER THE STA ARE COVERED BY THE OVERLAPPING GRADE B CONTOURS OF THREE OTHER OHIO AND INDIANA PBS STATIONS. THE RESULT IS THAT VERY FEW VIEWERS WILL BE DENIED PBS PROGRAMMING AS A RESULT OF WBGU-TV'S REDUCED POWER. AND THIS CONCLUSION DOES NOT EVEN TAKE INTO ACCOUNT THAT MANY OF THOSE POTENTIALLY LOST VIEWERS WILL ACTUALLY RECEIVE OTHER STATIONS' PBS PROGRAMMING OR WBGU-TV'S OWN SIGNAL VIA CABLE OR DIRECT SATELLITE RECEPTION.

UNDER ALL OF THE ABOVE CIRCUMSTANCES, BGSU URGES THAT GOOD CAUSE HAS BEEN SHOWN FOR THE REQUESTED 11-MONTH SPECIAL STA. ALTERNATIVELY, BGSU REQUESTS THAT A STANDARD SIX-MONTH STA BE GRANTED WITH THE STANDARD SIX-MONTH EXTENSION OPTION.
