WLUC-DT IS CURRENTLY OPERATING LICENSED DTV FACILITIES AT 63 KW EFFECTIVE RADIATED POWER (ERP) ON ITS ALLOTED POST TRANSITION DTV CHANNEL 35. ITS LICENSEE ALSO HOLDS A PERMIT TO CONSTRUC POST-TRANSITION FACILITIES AT 83 KW ERP. IT SEEKS AN EXTENSION WITH RESPECT TO THIS 83 KW CONSTRUCTION PERMIT.

PURSUANT TO PARAGRAPH 94(2) OF THE COMMISSION'S REPORT & ORDER IN ITS THIRD PERIODIC REVIEW OF THE DTV TRANSITION, FCC 07-228, WLUC-DT HAS FILED AN APPLICATION FOR SPECIAL TEMPORARY AUTHORITY TO OPERATE AT ITS EXISTING LICENSED EFFECTIVE RADIATED POWER (ERP), 63 KW, AFTER FEBRUARY 17, 2009. THIS AUTHORIZATION WOULD ALLOW WLUC-DT TO USE A TRANSMITTER BEING RETIRED FROM A COMMONLY OWNED STATION ON FEBRUARY 17, 2009 TO BUILD FACILITIES THAT WILL PROVIDE SERVICE AT 83 KW, THE ERP SPECIFIED IN THE STATION'S CONSTRUCTION PERMIT AND IN APPENDIX B TO THE COMMISSION'S ORDER ADOPTING THE DTV TABLE OF ALLOTMENTS. AS THE STATION EXPLAINED IN ITS STA REQUEST, CONTINUED OPERATION OF THE STATION'S LICENSED 63 KW FACILITIES PENDING COMPLETION OF THE 83 KW FACILITIES WOULD COMPLY WITH THE REQUIREMENTS OF PARAGRAPH 94(2) OF THE THIRD PERIODIC REPORT AND ORDER.

THE STATION UNDERSTANDS THAT GRANT OF ITS PENDING STA REQUEST WILL EXTEND THE DEADLINE FOR IT TO CONSTRUCT THE 83 KW FACILITIES AUTHORIZED BY ITS CONSTRUCTION PERMIT. OUT OF AN ABUNDANCE OF CAUTION, HOWEVER, THE STATION RESPECTFULLY REQUESTS EXTENSION OF ITS 83 KW CONSTRUCTION PERMIT UNTIL AUGUST 17, 2009, OR SUCH EARLIER TIME AS THE STATION COMPLETES CONSTRUCTION OF ITS 83 KW FACILITIES.
