Description: NEED FOR STA

SATV10, LLC REQUESTS APPROVAL OF THE INSTANT STA REQUEST FOR A REDUCED POST-TRANSITION FACILITY FOR THE REASONS SET FORTH IN THE ATTACHED ENGINEERING STATEMENT. ALTERNATIVELY, SATV10, LLC REQUESTS APPROVAL ON THE GROUNDS THAT STATION KTRG(TV) SHOULD BE AFFORDED ADDITIONAL FLEXIBILITY TO COMPLETE CONSTRUCTION. THE COMMISSION HAS INDICATED ITS WILLINGNESS TO CONSIDER, ON A CASE-BY-CASE BASIS, REQUESTS FOR ADDITIONAL REGULATORY RELIEF FILED BY SMALL MARKET STATIONS (I.E., STATIONS THAT ARE NOT A TOP-FOUR NETWORK IN MARKETS 1-100). KTRG(TV) IS SUCH A STATION BECAUSE IT IS AN INDEPENDENT SPANISH-LANGUAGE STATION LICENSED TO THE COMMUNITY OF DEL RIO, TEXAS AND IS NOT AFFILIATED WITH THE TOP FOUR NETWORKS. AS PREVIOUSLY REPORTED TO THE COMMISSION IN THE STATION'S MOST RECENT CONSTRUCTION-PERMIT EXTENSION REQUEST, THE STATION WAS PURCHASED OUT OF BANKRUPTCY AND ADDITIONAL FINANCIAL HARDSHIPS HAVE DELAYED CONSTRUCTION OF THE FULL FACILITY. FOR THE REASONS SET FORTH IN THE CONSTRUCTION-PERMIT EXTENSION REQUEST, COMMENSURATE RELIEF IS REQUESTED HERE TO PERMIT SATV10 TO CONSTRUCT AND OPERATE A REDUCED POST-TRANSITION FACILITY.
