CHANNEL 12 OF BEAUMONT, INC., LICENSEE OF STATION KBMT-DT, CHANNEL 50, BEAUMONT, TEXAS (HEREINAFTER KBMT), RESPECTFULLY REQUESTS SPECIAL TEMPORARY AUTHORITY (STA) TO OPERATE ON CHANNEL 50 POST-TRANSITION.

KBMT WAS INITIALLY ALLOTTED CHANNEL 50 AS ITS DIGITAL CHANNEL AND HAS OPERATED ON CHANNEL 50 SINCE AUGUST, 2002. IN JANUARY, 2005, KBMT FILED FCC FORM 382 AND ELECTED CHANNEL 12 AS ITS FINAL DTV IN-CORE CHANNEL NUMBER. A MODIFICATION OF CONSTRUCTION PERMIT APPLICATION (BMPCT-20051202AIQ) WAS GRANTED ON JANUARY 26, 2006 AND THE LICENSE COVERING THE OUTSTANDING CONSTRUCTION PERMIT WAS GRANTED ON JULY 12, 2007 (BLCDT-20060918AHX). THE MODIFICATION APPLICATION ESSENTIALLY WAS A MAXIMIZATION APPLICATION AND PROVIDES SERVICE TO 88.8% OF THE KBMT ANALOG CHANNEL 12 POPULATION.1/

A CONSTRUCTION PERMIT TO OPERATE ON DIGITAL CHANNEL 12 WAS GRANTED ON APRIL 16, 2008 (BPCDT-20080317ABX). KBMT ANALOG CHANNEL 12 WILL OPERATE ON ANALOG CHANNEL 12 UNTIL MIDNIGHT, FEBRUARY 17, 2009, AS IS STATED IN THE FCC FORMS 387 PREVIOUSLY FILED IN FEBRUARY, 2008 AND JULY, 2008. THE TRANSMITTER HOUSING FOR THE NEW DT CHANNEL 12 TRANSMITTER NOW HOUSES THE ANALOG CHANNEL 12 TRANSMITTER. CONSEQUENTLY, THE ANALOG TRANSMITTER MUST BE DISASSEMBLED AND THE NEW DT CHANNEL 12 TRANSMITTER ASSEMBLED. IT IS ANTICIPATED THAT THE CONVERSION PROCESS SHOULD ENTAIL APPROXIMATELY 30 TO 45 DAYS FROM FEBRUARY 18, 2009. IN THE INTERIM PERIOD (PRIOR TO THE COMPLETION OF CONSTRUCTION ASSOCIATED WITH THE PROSPECTIVE KBMT-DT CHANNEL 12 OPERATION), KBMTS ABILITY TO PROVIDE SERVICE WILL BE SOLELY DEPENDENT UPON THE CONTINUED OPERATION OF DT CHANNEL 50.

THE KBMT STA REQUEST IS FOUNDED ON THE THIRD PERIODIC REVIEW OF THE COMMISSIONS RULES AND POLICIES AFFECTING THE CONVERSION, REPORT AND ORDER, 43 C.R. 683 (DECEMBER 31, 2007), HEREINAFTER REPORT AND ORDER, SPECIALLY, PARAGRAPH 92 AND FOOTNOTE 276. THE KBMT CHANNEL 50 OPERATION WILL SERVE 100% OF THE POPULATION NOW RECEIVING CHANNEL 50 DT SERVICE AND 88.8% OF THE KBMT ANALOG POPULATION. THE KBMT POST-TRANSITION CHANNEL 50 OPERATION WILL NEITHER CAUSE NOR RECEIVE OBJECTIONABLE INTERFERENCE AS DEFINED BY THE FCC RULES (SEE ENGINEERING EXHIBIT APPENDED TO EXHIBIT 21). ABSENT A GRANT OF THE STA, ALMOST 600,000 PERSONS WILL LOSE KBMT PROGRAMMING INCLUDING ABC NETWORK PROGRAMMING. THE STA REQUEST COMPLIES WITH THE SPECIFIC REQUIREMENTS OF THE REPORT AND ORDER, PARAGRAPH 92 AND FOOTNOTE 276 AND CLEARLY DEMONSTRATES THE EXTRAORDINARY CIRCUMSTANCES UNDERLYING THE STA REQUEST, INCLUDING THE ONLY METHOD BY WHICH PROGRAMMING CAN CONTINUE TO BE PROVIDED TO A SUBSTANTIAL AUDIENCE SURELY AN OVERWHELMING PUBLIC INTEREST FACTOR.

1/ THE CHANNEL 50 MODIFICATION OF CONSTRUCTION PERMIT APPLICATION (BMPCT-20051202AIQ) USED THE SAME POPULATION NUMBERS AS IS SET FORTH IN THE ATTACHED ENGINEERING STATEMENT BUT REFLECTED 88.5% OF THE ANALOG POPULATION BEING SERVED. THE 88.8% REFLECTED IN THE ATTACHED ENGINEERING STATEMENT IS THE CORRECT PERCENTAGE.
