CHANNEL 12 OF BEAUMONT, INC. (CHANNEL 12) INITIALLY WAS GRANTED A CONSTRUCTION PERMIT (CONSISTENT WITH FACILITIES SPECIFIED IN APPENDIX B) ON APRIL 16, 2008 (BPCDT-20080317ABX). AN APPLICATION FOR MODIFICATION OF THE OUTSTANDING CONSTRUCTION (MAXIMIZED APPLICATION) WAS INITIALLY GRANTED NOVEMBER 12, 2008 WITH A CONDITION AND SUBSEQUENTLY RE-ISSUED ON DECEMBER 19, 2008 WITHOUT A CONDITION.1/ THE GRANT OF THE CONSTRUCTION PERMIT FOR THE MAXIMIZED APPLICATION REPLACED THE INITIAL CONSTRUCTION PERMIT FOR THE APPENDIX B FACILITY. THE INSTANT STA PROPOSES OPERATION WHICH WOULD EXTEND THE NOISE LIMITED CONTOUR BEYOND THE CONTOUR SPECIFIED IN THE INITIAL APPENDIX B CONSTRUCTION PERMIT BUT WHOLLY WITHIN THE CONTOUR SPECIFIED IN THE MAXIMIZED CONSTRUCTION PERMIT.2/ IN LIGHT OF THE FACT THAT THE PROPOSED STA OPERATION DIFFERS FROM THE OUTSTANDING MAXIMIZED CONSTRUCTION PERMIT (BUT IS WHOLLY CONTAINED WITHIN THE CONTOUR OF THE MAXIMIZED CONSTRUCTION PERMIT), SPECIAL TEMPORARY AUTHORITY IS HEREWITH REQUESTED. 1/ THE INITIAL GRANT INVOLVED SEVERAL MUTUALLY-EXCLUSIVE APPLICATIONS AND WAS SUBJECT TO RESCISSION/DISMISSAL IF THE PARTIES WERE UNABLE TO RESOLVE THE PROBLEM. THE PARTIES ENTERED INTO A MUTUAL INTERFERENCE ACCEPTANCE AGREEMENT, WHICH WAS THE BASIS FOR THE RE-ISSUANCE WITHOUT A CONDITION.

2/ OPERATION PURSUANT TO THE MAXIMIZED CONSTRUCTION PERMIT IS EXPECTED TO COMMENCE IN THE THIRD QUARTER OF 2009.

THE ATTACHED ENGINEERING STATEMENT PROVIDES DETAILS AND PURPOSE FOR THE PROPOSED STA.
