ON FEBRUARY 17, 2009, WAGM-TV/DT WILL PERMANENTLY TERMINATE ITS ANALOG OPERATIONS ON CHANNEL 8 AND ITS PRE-TRANSITION DIGITAL OPERATIONS ON CHANNEL 16 AS PART OF ITS EARLY TRANSITION TO DIGITAL-ONLY OPERATIONS ON CHANNEL 8.

WAGM-TV/DT RESPECTFULLY REQUESTS A WAIVER OF THE 30-DAY PRIOR NOTICE OBLIGATION CONTAINED IN THE COMMISSIONS DTV THIRD PERIODIC REPORT AND ORDER BECAUSE WAGM-TV DID NOT INTEND, PRIOR TO THE DELAY OF THE DTV TRANSITION DEADLINE, THAT IT WOULD NEED TO FILE A NOTICE WITH THE COMMISSION BECAUSE, UNTIL THAT TIME, ITS PLANNED TRANSITION TO DIGITAL-ONLY OPERATIONS WOULD NOT HAVE BEEN CONSIDERED EARLY.

BEGINNING ON JANUARY 29, 2009, WAGM-TV/DT WILL BEGIN BROADCASTING THE REQUIRED ON-AIR VIEWER NOTIFICATIONS ON BOTH ITS ANALOG AND PRE-TRANSITION DIGITAL SIGNALS. DURING THIS TIME, WAGM-TV/DT WILL BROADCAST 30 DAYS WORTH OF ON-AIR VIEWER NOTIFICATIONS. IN OTHER WORDS, IT WILL BROADCAST A TOTAL OF 120 ANNOUNCEMENTS, AT LEAST 30 OF WHICH WILL AIR DURING PRIMETIME.

DESPITE THE DELAYED DTV TRANSITION DEADLINE, WAGM-TV INTENDS TO FULLY TRANSITION TO DIGITAL-ONLY OPERATIONS BECAUSE, LONG AGO, IT MADE FINAL ARRANGEMENTS FOR THE REQUIRED DTV TRANSITION WORK AND PREPARATIONS TO TAKE PLACE ON FEBRUARY 17, 2009. IN ADDITION, THROUGH ITS DTV CONSUMER EDUCATION INITIATIVES AND ITS CURRENT ON-AIR VIEWER NOTIFICATIONS, WAGM-TV/DTS VIEWERS NOW EXPECT IT TO CONDUCT ITS DTV TRANSITION ON FEBRUARY 17, 2009. THEREFORE, A DIFFERENT TRANSITION DATE WOULD LEAD TO CONFUSION AMONG WAGM-TV/DTS VIEWERS.
