REASON FOR EXTENSION OF STA

AS NOTED IN THE MOST RECENT EXTENSION, BESTA-20080804ABY, THE ORIGINAL STA WAS GRANTED TO TO RELOCATE THE TRANSMITTER FROM A SITE ON CLINCH MOUNTAIN IN VIRGINIA TO A SITE ON BAYS MOUNTAIN IN TENNESSEE, AS PROPOSED IN BPTVL-20070208ABJ. AN STA WAS NEEDED TO PERMIT AN IMMEDIATE MOVE BECAUSE AN UNRELIABLE POWER SUPPLY AT THE LICENSED SITE HAD RESULTED IN THE STATION'S GOING DARK. BPTVL-20070208ABJ WAS GRANTED ON MARCH 6, 2007. THUS PERMANENT OPERATION AT THE STA SITE IS ASSURED.

THE STA IS FOR LOWER POWER THAN SPECIFIED IN THE CONSTRUCTION PERMIT. A LARGER TRANSMITTER IS NEEDED TO FULLY BUILD OUT THE CONSTRUCTION PERMIT; BUT AS WE HAVE PREVIOUSLY STATED IN STA REQUEST, WE ARE CONCERNED ABOUT BUYING A NEW ANALOG TRANSMITTER WHEN THE DIGITAL TRANSITION FOR LPTV STATIONS IS COMING.

WE THOUGHT THAT A DIGITAL TRANSITION PROGRAM FOR LPTV STATIONS MIGHT HAVE BEEN ESTABLISHED BY NOW, BUT THAT HAS NOT HAPPENED. MOREOVER, RECENT LEGISLATION THAT WILL EXTEND THE FULL POWER TRANSITION DATE ADDS TO THE UNCERTAINTY ABOUT THE LPTV TRANSITION.

AN EXTENSION OF THE STA IS REQUESTED TO ALLOW ANALOG OPERATION WITH REDUCED POWER FROM THE BAYS MOUNTAIN SITE, USING THE STATION'S EXISTING TRANSMITTER, PENDING FURTHER ANNOUNCEMENTS BY THE COMMISSION ABOUT THE LPTV DIGITAL TRANSITION.

THE CONSTRUCTION PERMIT ON WHICH THE STA IS BASED DOES NOT EXPIRE UNTIL MARCH 6, 2010, SO THERE IS NO ISSUE OF AN IMPENDING EXPIRATION DATE. THE LICENSEE UNDERSTANDS THAT THIS STA WILL NOT EXTEND THE PERMIT, SO A DECISION WILL HAVE TO BE MADE WITHIN THE NEXT YEAR ABOUT WHETHER TO BUY A LARGER ANALOG TRANSMITTER, REDUCE THE ANALOG ERP SPECIFIED IN THE CONSTRUCTION PERMIT, OR APPLY TO MODIFY THE CONSTRUCTION PERMIT TO SPECIFY DIGITAL OPERATION.

THE STATION IS CURRENTLY ON THE AIR AT REDUCED POWER UNDER THE EXISTING STA.
