THE SOLE PURPOSE OF THIS AMENDMENT IS TO RESPOND TO THE COMMISSION'S FEBRUARY 13, 2009 DEFICIENCY LETTER (REF. NO. 1800E1-MTU), WHICH STATES THAT THIS APPLICATION PROPOSES FACILITIES PREDICTED TO CAUSE INTERFERENCE TO STATION WCGV-TV, BLCT-19920902KF, CHANNEL 24, MILWAUKEE, WI. AS IS REFLECTED IN THE ATTACHED EXHIBIT 2 TECHNICAL STATEMENT OF DU TREIL, LUNDIN & RACKLEY, INC., WCGV-TV CEASED TO BROADCAST ON CHANNEL 24 AS OF FEBRUARY 17, 2009, AND THERE IS THEREFORE NO INTERFERENCE CAUSED TO THAT FACILITY, BECAUSE IT NO LONGER EXISTS. AS FURTHER REFLECTED IN THE EXHIBIT 2 TECHNICAL STATEMENT, THE PROPOSED WMLW-CA FACILITY MEETS ALL INTERFERENCE PROTECTION REQUIREMENTS.

WMLW-CA ON CHANNEL 41 IS SUBJECT TO DISPLACEMENT FROM FULL-POWER STATION WGBA-DT, GREEN BAY, WI, CHANNEL 41, WHICH IS LOCATED 138.6 KM NORTH OF THE WMLW-CA TRANSMITTER SITE.

PURSUANT TO FCC POLICY, THE INSTANT PROPOSAL WAS BASED ON A POST-TRANSITION OET-69 INTERFERENCE ANALYSIS. SEE ATTACHED EXHIBIT.
