REQUEST FOR EARLY TRANSITION AUTHORITY

ON MARCH 17, 2009, THE LICENSEE OF STATION WDBD(TV), JACKSON, MISSISSIPPI, ADVISED THE COMMISSION OF ITS INTENT TO TERMINATE ANALOG OPERATION ON MAY 4, 2009. PURSUANT TO THE THIRD PERIODIC DTV REVIEW REPORT AND ORDER, 23 FCC RCD 2994 (2007) AND THE FCC'S PUBLIC NOTICE 09-6, THE LICENSEE OF THE STATION HEREBY REQUESTS 'EARLY TRANSITION' AUTHORITY TO TERMINATE DIGITAL SERVICE ON ITS PRE-TRANSITION CHANNEL AND BEGIN OPERATING ON ITS POST-TRANSITION DTV CHANNEL ON MAY 4, 2009. WDBD-DT WILL BE TRANSITIONING FROM ITS PRE-TRANSITION DTV CHANNEL (41) TO ITS CURRENT NTSC CHANNEL (40). AT THIS TIME, THE STATION HAS RECEIVED ITS CONSTRUCTION PERMIT FOR POST-TRANSITION FACILITIES AND HAS SCHEDULED CONSULTING ENGINEERING FOR EARLY MAY TO IMPLEMENT THIS CONSTRUCTION PERMIT. SEE FCC FILE NO. BPCDT-20080401ATJ. BECAUSE THESE CONSULTANTS HAD TO RESCHEDULE ALL EXISTING ARRANGEMENTS TO ACCOMMODATE EXTENSION OF THE DTV TRANSITION DATE, THEY WILL NOT BE AVAILABLE AGAIN UNTIL EARLY AUGUST.

EARLY TRANSITION WILL PERMIT IN-MARKET STATION WUFX(TV), VICKSBURG, MISSISIPPI, TO TIMELY COMMENCE DIGITAL OPERATION ON CHANNEL 41. AS WUFX(TV) HAS ADVISED THE COMMISSION, THE STATION IS PREPARED TO TERMINATE ANALOG OPERATION ON MAY 5, 2009. BECAUSE WUFX(TV) IS NOT CONDUCTING PRE-TRANSITION DIGITAL OPERATION, THE STATION IS RELYING UPON WDBD-DT TO COMPLETE THE EARLY TRANSITION REQUESTED HEREIN IN ORDER TO COMMENCE DIGITAL OPERATION.

AS DETAILED IN THE ATTACHED TECHNICAL EXHIBIT, THE INSTANT REQUEST MEETS THE CRITERIA SET FORTH BY THE COMMISSION IN THAT (1) THE POST-TRANSITION OPERATION WILL NOT CAUSE IMPERMISSIBLE INTERFERENCE TO ANOTHER STATION; AND (2) THE POST-TRANSITION OPERATION WILL SERVE THE PRE-TRANSITION OPERATION'S EXISTING VIEWERS FOR THE REMAINDER OF THE TRANSITION. ACCORDINGLY, STATION WDBD-DT HEREBY SEEKS AUTHORITY TO TERMINATE PRE-TRANSITION DIGITAL OPERATION ON MAY 4, 2009, PERMITTING IT TO COMMENCE POST-TRANSITION DIGITAL OPERATION.
