JUSTIFICATION

TODAY, THE STATION COMPLETED CONSTRUCTION OF THE POST-TRANSITION DTV FACILITY AUTHORIZED IN FCC FILE NO. BPCDT-20080619ADJ. DUE TO AN UNANTICIPATED PROBLEM WITH THE STATION'S TRANSMITTER, HOWEVER, THE FACILITY WAS ONLY ABLE TO ACHIEVE 72% ERP (I.E., APPROXIMATELY 14.4 KW). THE STATION HAS ALREADY ORDERED THE NECESSARY REPLACEMENT PARTS, WHICH ARE EXPECTED TO ARRIVE SOMETIME NEXT WEEK (I.E., DURING THE WEEK OF JUNE 14, 2009). ONCE THE PARTS ARRIVE, THE STATION WILL WORK DILIGENTLY TO MAKE THE REPAIRS NECESSARY TO ACHIEVE FULL POWER OPERATION. THE STATION ANTICIPATES THAT SUCH REPAIRS CAN BE COMPLETED, AND THAT OPERATION AT 100% POWER CAN BE ACHIEVED, BY JUNE 30, 2009.

CONCURRENTLY HEREWITH, THE STATION IS FILING A REQUEST FOR SPECIAL TEMPORARY AUTHORITY TO COVER THE REDUCED POWER OPERATION.
