FOLSE COMMUNICATIONS, LLC, THE LICENSEE OF KJUN-CA, MORGAN CITY, LOUISIANA, FAC. ID. 24979, HEREBY REQUESTS AUTHORITY TO OPERATE KJUN-CA AT A VARIANCE FROM ITS AUTHORIZED ANALOG FACILITIES.

ON SEPTEMBER 1, 2008, THE STATION WAS FORCED OFF THE AIR DUE TO HURRICANE GUSTAV. FOLSE NOTIFIED THE COMMISSION OF THIS SITUATION ON SEPTEMBER 10, 2008 AND FILED A REQUEST FOR AUTHORITY TO REMAIN SILENT ON SEPTEMBER 29, 2008. THE FCC GRANTED THIS REQUEST ON SEPTEMBER 30, 2008, WHICH FOLSE SOUGHT TO RENEW ON FEBRUARY 27, 2009. THE FCC GRANTED THIS FURTHER REQUEST ON MARCH 3, 2009.

THE STATION MUST RESUME OPERATIONS NO LATER THAN SEPTEMBER 1, 2009. FOLSE SEEKS THIS STA TO ALLOW KJUN-CA TO DO THIS AND THUS INTERRUPT THE TIME PERIOD THAT THE STATION HAS BEEN SILENT TO AVOID FORFEITING THE LICENSE AND DEPRIVING VIEWERS IN MORGAN CITY OF THIS VALUABLE SERVICE. FOR THIS REASON, FOLSE FURTHER SEEKS EXPEDITED TREATMENT FOR THIS STA REQUEST.

ORIGINALLY, FOLSE HAD PLANNED TO BRING UP KJUN-CA WITHIN THE REQUISITE TIME PERIOD IN DIGITAL UNDER THE PERMIT ISSUED IN BMPDVA-20080804ABK. UNFORTUNATELY, FOLSE HAS ENCOUNTERED SOME DELAYS WHICH WILL MAKE IT IMPOSSIBLE TO GET THE DIGITAL TRANSMITTER INSTALLED AND OPERATING BY SEPTEMBER 1. HOWEVER, FOLSE RECOGNIZES THAT IT MUST BRING THE STATION BACK ON THE AIR AND HAS DETERMINED THAT IT CAN DO SO USING THE DIGITAL ANTENNA AND OLD ANALOG TRANSMITTER TO PROVIDE THE NECESSARY SERVICE TO INTERRUPT THE PERIOD THAT THE STATION HAS BEEN OFF THE AIR. FOLSE RESPECTFULLY REQUESTS A GRANT OF SPECIAL TEMPORARY AUTHORITY FOR 6 MONTHS TO ALLOW IT TO OPERATE AT THE PARAMETERS SPECIFIED IN THIS APPLICATION TO ENSURE THAT IT HAS AMPLE TIME TO COMPLETE CONSTRUCTION OF KJUN-CA'S DIGITAL FACILITIES WHILE STILL ALLOWING IT TO SERVE ITS COMMUNITY.

GRANTING THIS STA IS IN THE PUBLIC INTEREST AS IT BRINGS BACK MUCH NEEDED SERVICE TO THE MORGAN CITY, LOUISIANA AREA AND PREVENTS THE LICENSE FOR KJUN-CA FROM BEING LOST TO FORFEITURE.

IT IS NOTED THAT THE PROPOSED STA SITE COORDINATES DIFFER FROM THE KJUN-CA LICENSED COORDINATES BY ONLY 1 SECOND OF LONGITUDE. THEREFORE, THE 68 DBU CONTOUR OF THE PROPOSED STA FACILITY WILL OVERLAP THE LICENSED 68 DBU CONTOUR.

INTERFERENCE COMPLIANCE:

A POST-TRANSITION INTERFERENCE STUDY HAS BEEN CONDUCTED TO ASSURE THAT THE STA PROPOSAL WILL NOT CREATE PROHIBITED INTERFERENCE TO PERTINENT STATIONS. USING THE PROCEDURES OUTLINED IN THE FCCS OET-69 BULLETIN, A 1 KILOMETER GRID, AND 2000 U.S. CENSUS, THE PROPOSAL COMPLIES WITH THE CURRENT FCC POLICY. IF NECESSARY, A WAIVER OF THE FCC RULES IS RESPECTFULLY REQUESTED BASED ON USE OF THE PROCEDURES OUTLINED IN THE FCCS OET-69 BULLETIN.

RFR COMPLIANCE:

THE PROPOSED KFOL-CA FACILITIES WERE EVALUATED IN TERMS OF POTENTIAL RADIOFREQUENCY RADIATION EXPOSURE AT 2 METERS ABOVE GROUND LEVEL IN ACCORDANCE WITH OST BULLETIN NO. 65, EVALUATING COMPLIANCE WITH FCC-SPECIFIED GUIDELINES FOR HUMAN EXPOSURE TO RADIOFREQUENCY RADIATION. THIS BULLETIN PROVIDES ASSISTANCE IN DETERMINING WHETHER FCC-REGULATED TRANSMITTING FACILITIES, OPERATIONS OR DEVICES COMPLY WITH LIMITS FOR HUMAN EXPOSURE TO RADIOFREQUENCY (RF) ELECTROMAGNETIC FIELDS ADOPTED BY THE COMMISSION IN 1996.   

THE CALCULATED POWER DENSITY AT 2 METERS ABOVE GROUND LEVEL AT THE BASE OF THE TOWER WAS CALCULATED USING THE APPROPRIATE EQUATION CONTAINED IN THE BULLETIN. USING A WORST CASE VERTICAL RELATIVE FIELD VALUE OF 1, A MAXIMUM VISUAL ERP OF 0.009 KILOWATT, 10% AURAL POWER, AND AN ANTENNA CENTER OF RADIATION HEIGHT ABOVE GROUND LEVEL OF 111.9 METERS, THE CALCULATED POWER DENSITY AT TWO METERS ABOVE GROUND LEVEL AT THE BASE OF THE STRUCTURE IS 0.00002 MILLIWATT PER SQUARE CENTIMETER (MW/CM2), OR 0.01 PERCENT OF THE COMMISSION'S RECOMMENDED LIMIT APPLICABLE TO GENERAL POPULATION/UNCONTROLLED EXPOSURE AREAS (0.2 MW/CM2 FOR TV CHANNEL 7). THEREFORE, THE FACILITY COMPLIES WITH THE FCCS RF EMISSION RULES.

ACCESS TO THE TRANSMITTING SITE WILL BE RESTRICTED AND APPROPRIATELY MARKED WITH WARNING SIGNS. FURTHERMORE, AN AGREEMENT WILL BE IN EFFECT TO CONTROL ACCESS TO THE SITE. IN THE EVENT THAT WORKERS OR OTHER AUTHORIZED PERSONNEL ENTER THE RESTRICTED AREA APPROPRIATE MEASURES SHALL BE TAKEN TO LIMIT RF ENERGY EXPOSURE. SUCH MEASURES INCLUDE LIMITING THE EXPOSURE TIME, WEARING PROTECTIVE CLOTHING, REDUCING POWER TO AN ACCEPTABLE LEVEL OR TERMINATION OF TRANSMITTER OUTPUT POWER ALL TOGETHER UNTIL WORKERS LEAVE THE RESTRICTED AREA.

IT IS NOTED THAT THIS STATEMENT ONLY ADDRESSES THE POTENTIAL FOR RADIOFREQUENCY ELECTROMAGNETIC FIELD EXPOSURE ALL OTHER ASPECTS OF THE ENVIRONMENTAL PROCESSING ANALYSIS WILL BE OR ALREADY HAVE BEEN PROVIDED TO THE FCC BY THE TOWER OWNER.
