REASON FOR EXTENSION

TPT CURRENTLY HOLDS A CONSTRUCTION PERMIT TO CHANGE THE CHANNEL OF STATION KTCI-TV, ST. PAUL, MINNESOTA (FILE NO. BPEDT-20090716ACS, GRANTED JULY 22, 2009). THIS CP EFFECTUATED A CHANGE OF TPT'S POST-TRANSITION CHANNEL ADOPTED JULY 1, 2009 BY THE FCC IN DOCKET NO. 08-117 (ADOPTED JULY 1, 2009). BOTH THE CURRENT CP AND THE CURRENT STA (FILE NO. BDSTA-20080818ABZ) EXPIRE OCTOBER 18, 2009, AND APPLICATIONS FOR EXTENSION OF BOTH ARE BEING SIMULTANEOUSLY FILED.

THE CURRENT EXPIRATION DATE WAS ESTABLISHED BY THE FCC IN ITS IMPLEMENTATION OF THE DTV DELAY ACT BY THIRD REPORT AND ORDER ON RECONSIDERATION FCC 09-19, RELEASED MARCH 13, 2009. THE COMMISSION ANTICIPATED THAT SOME LICENSEES WOULD REQUIRE ADDITIONAL TIME FOR CONSTRUCTION, AND STATED THAT TIME UNTIL FEBRUARY 17, 2010 WOULD BE ALLOWED FOR CONSTRUCTION WHERE THOSE STATIONS SATISFIED THE REQUIREMENT FOR EXTENDED STA. TPT SUBMITS IT HAS MET THE REQUIREMENT, AS FOLLOWS:

TPT REQUIRED THE CHANGE OF ITS FINAL DTV CHANNEL BECAUSE THE CHANNEL ORIGINALLY ALLOTTED, EVEN MAXIMIZED, COULD NOT REPLICATE THE ANALOG SERVICE AREA OF STATION KTCI-TV. TPT COULD NOT BEGIN CONSTRUCTION OF ITS CHANNEL *23 FACILITY UNTIL ITS ANALOG EQUIPMENT WAS REMOVED FROM SERVICE AND DISMANTLED. TPT HAD TO ORDER EQUIPMENT AND SCHEDULE INSTALLATION. WHILE MUCH OF THE ADMINISTRATIVE WORK WAS DONE WHILE THE RULEMAKING AND APPLICATION WERE PENDING, THERE HAS BEEN INSUFFICIENT TIME SINCE JULY 22, 2009 TO COMPLETE ORDERING AND INSTALLATION OF ALL EQUIPMENT. THE EQUIPMENT WAS ORDERED IN LATE JULY AND DELIVERY IS NOW SCHEDULED FOR NOVEMBER 15, 2009, AT THE EARLIEST. CONSTRUCTION WILL REQUIRE APPROXIMATELY 45 MORE DAYS FOR EXTENSIVE INSTALLATION AND TUNING OF THE RF COMBINING NETWORK. TPT HOPES TO HAVE THIS COMPLETED BY JANUARY 1, 2010. OUT OF AN ABUNDANCE OF CAUTION, THE FULL TIME ALLOWED BY THE DTV DELAY ACT, OR UNTIL FEBRUARY 10, 2010, IS REQUESTED.
