REASONS REQUIRING ADDITIONAL TIME TO CONSTRUCT

THE LICENSEE BELIEVES THAT IT MAY STILL MEET THE MAY 1, 2002 DEADLINE BUT FILES THIS REQUEST FOR EXTENSION OF TIME IN AN ABUNDANCE OF CAUTION.

THERE IS AN EXISTING TOWER ON WHICH THE ANTENNA WILL BE LOCATED. ALL NECESSARY EQUIPMENT HAS BEEN ORDERED, INCLUDING:

TLP 16A ANTENNA AND TRANSMISSION LINE FROM DIELECTRIC
DIGITAL ENCODING EQUIPMENT FROM TELEVIDEO
DCX BEACHHEAD TRANSMITTER AND 480I ENCODER FROM THALES

DUE TO OVERWHELMING DEMAND FOR THESE DEVICES, THERE HAS BEEN A DELAY IN FULFILLING THESE ORDERS. THIS HAS OCCURRED THROUGH NO FAULT OF THE LICENSEE.   DELIVERY IS NOW EXPECTED TO OCCUR ON MARCH 27, 2002. ASSUMING THIS DELIVERY OCCURS AS SCHEDULED, THE STATION BELIEVES IT CAN BE OPERATIONAL ON JULY 1, 2002, PERHAPS SOONER.

STEPS BEING TAKEN TO COMPLETE CONSTRUCTION WITHIN EXTENDED TIME PERIOD

THE LICENSEE HAS DONE EVERYTHING WITHIN ITS POWER TO ENSURE THAT THE MAY 1, 2002 DEADLINE IS MET. EVEN IF THE LICENSEE CANNOT MEET THE MAY 1, 2002 DEADLINE, IT EXPECTS THE STATION TO BE ON THE AIR AT FULL POWER SHORTLY AFTERWARD; A SECONDARY DATE OF JULY 1, 2002 HAS BEEN SET.

THE LICENSEE ALREADY HAS A TOWER IN PLACE. THIS TOWER IS BEING ANALYZED BY THE STATION'S STRUCTURAL ENGINEER, WHO HAS DETERMINED THAT SOME MODIFICATION IS REQUIRED BEFORE LOCATING THE ANTENNA ON THE TOWER. THIS IS NOT EXPECTED TO DELAY THE DATE OF FIRST OPERATION.

THE DELAY HAS BEEN CAUSED THROUGH NO FAULT OF THE LICENSEE, WHO HAS TAKEN ALL NECESSARY STEPS TO MEET THE MAY 1, 2002 DEADLINE. THE LICENSEE HAS ORDERED AND PAID DEPOSITS ON AN ANTENNA AND TRANSMISSION LINE ($10,578 PAID), DIGITAL ENCODING EQUIPMENT ($5685 PAID), AND A TRANSMITTER AND ENCODER ($24,994 PAID). THE DELIVERY DATE ON THIS EQUIPMENT IS SCHEDULED FOR MARCH 27, 2002. ONCE THAT EQUIPMENT HAS BEEN DELIVERED, IT SHOULD BE INSTALLED AND FULLY OPERATIONAL NO LATER THAN JULY 1, 2002. DESPITE THE EXPECTATION THAT THE STATION SHOULD BE OPERATIONAL BY JULY 1, 2002, THE LICENSEE REQUESTS AN EXTENSION OF TIME TO CONSTRUCT UNTIL NOVEMBER 1, 2002 IN CASE ANY FURTHER UNEXPECTED DELAYS ARISE.
