CAUSE OF UNEXPECTED DELAY

THE CONSTRUCTION PERMIT FOR WGMB-DT WAS PREVIOUSLY EXTENDED TO OCTOBER 1, 2003. THE LICENSEE ANTICIPATED THAT THE CONSTRUCTION OF WGMB-DT DIGITAL FACILITIES WOULD BE COMPLETED BY THAT DATE, BUT, AS INDICATED IN THE ATTACHED LETTER FROM STEPHEN BLASETTI, SALES MANAGER FOR ACRODYNE INDUSTRIES, INC., SHIPMENT AND DELIVERY OF THE DTV TRANSMITTER HAS BEEN DELAYED. WHILE THE DELIVERY IS NOW EXPECTED WITHIN A FEW DAYS, THE INSTALLATION WILL REQUIRE ADDITIONAL TIME. THE LICENSEE ANTICIPATES THAT THE ENTIRE PROCESS SHOULD BE COMPLETE WITHIN THE NEXT TWO WEEKS, BUT IT IS REQUESTED A 30-DAY EXTENSION OF TIME IN ORDER TO ALLOW FOR ANY FURTHER UNFORESEEN DIFFICULTIES.

AS NOTED IN ITS PREVIOUS REQUEST FOR EXTENSION OF THE DTV CONSTRUCTION PERIOD, THE LICENSEE, THROUGH A SERIES OF HOLDING COMPANIES, IS A SUBSIDIARY OF COMMUNICATIONS CORPOATION OF AMERICA ('CCA'). CCA, THROUGH VARIOUS SUBSIDIARIES, HAS OWNERSHIP INTERESTS IN EIGHT TELEVISION STATIONS. CCA HAS PREVIOUSLY DEMONSTRATED TO THE COMMISSION THAT SUBSTANTIAL FINANCIAL DISTRESS HAS PREVENTED IT FROM GOING FORWARD WITH CONSTRUCTION OF DTV FACILITIES FOR ALL EIGHT STATIONS SIMULTANEOUSLY. AS SET FORTH IN RECENT APPLICATIONS FOR EXTENSION OF TIME TO CONSTRUCT THE DIGITAL FACILITIES OF OTHER STATIONS IN THE GROUP, HOWEVER, WGMB-DT IS ONE OF THE THREE STATIONS FOR WHICH IMMEDIATE CONSTRUCTION OF DTV FACILITIES HAS BEEN SCHEDULED. SEE, E.G., FORM 337 APPLICATION FOR KWKT-DT, FILE NO. BEPCDT-20030905AAB.

AS THE COMMISSION WAS INFORMED IN THOSE APPLICATIONS, THE INSTALLATION OF THE ANTENNA AND TRANSMISSION LINE FOR WGMB-DT HAS BEEN COMPLETED, AND ALL DIGITAL ENCODING AND MONITORING EQUIPMENT HAS BEEN DELIVERED. COMPLETION OF THE FACILITIES AND SIGN-ON HAS BEEN DELAYED, HOWEVER, BY DELAY IN SHIPMENT OF THE DTV TRANSMITTER. AS INDICATED IN THE ATTACHED LETTER, SHIPMENT HAS NOW BEEN SCHEDULED AND IS IMMINENT. ACRODYNE INDUSTRIES HAS ASSURED THE LICENSEE THAT IT IS TAKING EVERY STEP TO EXPEDITE DELIVERY OF THE TRANSMITTERS. ONCE DELIVERY IS MADE, THE LICENSEE WILL PROCEED FORWARD AS QUICKLY AS POSSIBLE WITH COMPLETION OF CONSTRUCTION. BECAUSE THREE STATIONS ARE INVOLVED (WGMB-DT, BATON ROUGE; KMSS-DT, SHREVEPORT, LOUISIANA; AND KVEO-DT, BROWNSVILLE, TEXAS), AND BECAUSE THOSE STATIONS ARE SPREAD OUT OVER A SUBSTANTIAL GEOGRAPHIC AREA, IT WILL NOT BE POSSIBLE TO INSTALL THE TRANSMITTERS AT ALL THREE STATIONS SIMULTANEOUSLY. WHILE THE LICENSEE ANTICIPATES THAT CONSTRUCTION OF ALL THREE STATIONS CAN BE COMPLETED WITHIN THE NEXT TWO TO THREE WEEKS, IT IS REQUESTING A 30 DAY EXTENSION TO PROVIDE SOME TIME CUSHION IN CASE OF UNANTICIPATED DIFFICULTIES. CLEARLY, THE PREVIOUS DELAYS IN SHIPMENT, AND ANY POSSIBLE FUTURE DELAYS IN CLEARING U.S. CUSTOMS ARE MATTERS BEYOND THE CONTROL OF THE LICENSEE AND THEREFORE FULLY SUPPORT THE BRIEF EXTENSION OF TIME REQUESTED HEREIN.
