STATEMENT CONCERNING CAUSES FOR DELAYS IN COMPLETION OF CONSTRUCTION

THE INITIAL WBPH-DT CP WAS PREVIOUSLY EXTENDED BECAUSE OF THE PENDENCY OF A RULE MAKING PROCEEDING (MM DOCKET NO.02-81)TO SUBSTITUTE CHANNEL 9 FOR CHANNEL 59 AS THE PAIRED DIGITAL CHANNEL ALLOTMENT FOR WBPH-TV, CHANNEL 60, BETHLEHEM, PENNSYLVANIA. THE MOST RECENT EXTENSION IS SCHEDULED TO EXPIRE ON APRIL 24, 2004. A CONSTRUCTION PERMIT MODIFYING THE WBPH-DT AUTHORIZATION TO SPECIFY OPERATION ON CHANNEL 9 (FILE NO. BMPCDT-20030522AD) WAS GRANTED ONLY ON FEBRUARY 26, 2004.

THE BRIEF PERIOD OF TIME REMAINING ON THE EXTENDED CONSTRUCTION PERMIT HAS BEEN INSUFFICIENT TO DEAL FULLY WITH THE SEVERAL MAJOR ISSUES CREATED BY THE SUBSTITUTION OF THE CHANNEL 9 VHF ALLOTMENT FOR THE UHF CHANNEL 59 ALLOTMENT AND COMPLETE CONSTRUCTION. FOR EXAMPLE, BOTH THE TRANSMITTER AND THE ANTENNA WILL NEED TO BE CUSTOMIZED FOR THE NEW VHF FACILITIES AUTHORIZED IN THE MODIFIED CONSTRUCTION PERMIT.   DIFFERENCES BETWEEN THE CHANNEL 9 AND CHANNEL 59 ANTENNAS REQUIRE RENEGOTIATION OF THE TOWER SPACE ARRANGEMENTS WITH THE TOWER OWNER. ACCORDINGLY, THIS EXTENSION OF TIME, AND POSSIBLY AN ADDITIONAL EXTENSION WILL BE REQUIRED.

STATEMENT CONCERNING APPLICANT'S EFFORTS TO COMPLETE CONSTRUCTION

IN THE BRIEF PERIOD OF TIME (LESS THAN FIVE WEEKS) SINCE THE MODIFIED CONSTRUCTION PERMIT WAS GRANTED, THE APPLICANT HAS HAD SEVERAL MEETINGS WITH REPRESENTATIVES OF THE TOWER OWNER TO RESOLVE ANY OUTSTANDING ISSUES CONCERNING SPACE FOR THE CHANNEL 9 ANTENNA. IN ADDITION, THE APPLICANT HAS RECEIVED PROPOSALS FOR THE CUSTOMIZED CHANNEL 9 TRANSMITTER AND ANTENNA AND ORDERS, WITH DEPOSITS, WILL BE PLACED SHORTLY.
